Entrapment? Arrested for intent to sell

Hey so long story short I want to know if this sounds like entrapment. Basically, this weekend we went to Coachella Music Festival and my girlfriend and I brought some joints and some pot brownies. On the second day of the festival we were approached by a lady asking us for a lighter. We said sure, gave her the lighter, she lit up her cigarette and proceded to talk to us. First she asked us if we could sell her weed and we said no. But she must of saw the brownies and turned her focus to those, asking if she could buy some brownies. We made a whole batch (too much for both us) and figured we could part with a handful. So my girlfriend sold her a handful for $5. At this point undercover cops come over and arrested her, charging her with two felonies (poss. of marijuana to sell and sale/transit of marijuana).

My question in this situation is...is this entrapment? Since we weren't advertising the brownies or drugs and weren't doing anything suspicious at the time.

Does anyone have any similiar stories? Of course my girlfriend (being 19) is freaking out about the potential of 2 felonies being on her record. However, I confident with a decent lawyer we can get this felonies knocked down to a misdameanor of poss.

Sounds really harsh. I guess your story is a reminder for everyone to be careful.

I don't have any advice but it sounds like you already know how to handle the situation (i.e. get a lawyer).

Well, you're supposed to ask anyone who approaches you if they are a cop. If they say no and they turn out to be a cop then that's entrapment. Either way, there's no way for them to have known they were pot brownies unless they asked. Otherwise you're gonna need a lawyer for this one.

Should have just gave her a few and 'Good Karma"" would have followed .. but due to the exchange of money you kinda cant get away from the "sale " charge . They have to test the brownies to see if they contain The active Ingr,(thc) If they dont test it dispute it .. Fight it out .. It was a music fest ... say SHE gave you the $5 for the lighter and you GAVE her the brownie,,..

Good lord... is this what it has come to? Cops wasting tax payer money hanging out at festivals to bust people over $5.00 worth of brownies? Not to mention this festival is in California.... which is suppose to have lenient laws!

Outrageous waste of taxpayer money and police time!

um entrapment isnt a real thing. if you do any research on it at all you get BS stories about it. my guess is its propaganda from the popos to trick you into dealing with them. Trust me my buddy sold a bag to a cop, asked him if he was a cop and the guy said no. got arrested and went to court and tried to say that it was entrapment and the judge laughed at him.

Ignorance is like child abuse it just keeps passing from one generation to the next. This is the most commonly stated piece of false knowledge i have ever heard. NO COP HAS TO TELL YOU THERE A COP!!! Hell i have seen em smoke before, then arrest, then they just show up in court and say "It's ok i did smoke but i have gotten treatment" Again please stop spreading misinformation, where do people get this shit. Asking a cop if there a cop will do you about as much good as those little fucking disclaimers everyone seems to wanna put in there sig. And for anyone who says im wrong, PROVE IT!!!

YUP NO SUCH THING AS ENTRAPMENT. i WITNESSED A SITUATION WHERE THIS GIRL GOT TRAPPED WITH THIS FUCKEN NARC(IT WAS SUPER OBVIOUS) STUPID ON HER PART TO GOT THROUGH WITH THE DEAL. BUT TO MAKE A LONG STORY SHORT. SHE COULDN'T USE ENTRAPMENT EVEN IF THE GUY DENIED IN BEING A COP. SHE ASKED HIM ATLEAST 10 TIMES BEFORE SHE SOLD IT TO HIM.

My daughter works for a public defender's office in California. She's in her second year of law school. She said their biggest problem is everything that comes out of the mouths of their clients. She also said the PD's office has a better record on DUI's and "green card" arrests because the judges like them better. On a first offense, she said it shouldn't be a problem. And if you just say you don't have the money, they'll even waive the $100 (or so) fee to have them represent you.

Cops don't have to tell you the truth, and have been known to out right lie. wouldn't depend on that too much.

This is a lie, that many people have been lead to believe. Undercover police officers do not have to reveal their identity to you. Can you imagine how many police officers would be dead?

Yea I hate to be in here after the fact but that's why you never sell shit like that to people you don't know, it's not worth it for that amount of money.
