The fact is you are growing a PLANT on public property. Just because it happens to be a pot plant doesn't make it any different. I admit my first post was inappropriate I implied that he should just uproot it, which I do think would be wrong on more than one level. But if it had buds on it there is no reason why he shouldn't be able to take some of it just like you would if it were an apple tree or berry patch. If you want a personal garden, you do it at your or a friends house. If not, you better make sure no one will find it.
