How bad is this situation?

I'd have the person who's name is on the lease read over the contract and also make sure that there was no attempt by the landlady to call or anything to say they were inspecting. Frankly if a landlady calls and reports it that's enough for a warrant. Trying to get into an unlawful entry with the land lady may land them in a mess with charges, at least conspiracy since they rented the place. Until someone hears from the cops I'd just take it as a learning experience and move on.

as anyone ever called a lawyer out the phone book?? its Not like they pick up the phone and start giving answers out its always a hassle you always start with a secretary that wants to know if your problem is even what that lawyer does then if it is you will need to make oppoinment and hes going wanna charge you if hes helping you figure shit out......

In ca we sign a lease agrement and inside that lease there is rules and rights and must submit to in order for that contract to be valid etc etc..... in mine is says they may entire with 24 notice if need be.... and they may enter if its like a fire etc etc..... So pull out your lease and READ it see if it says tha the landlord may entire and for what reason may he enter and how much time must they give in advance if any.... I ca has some state laws that govern what is in the lease contract......

Also like others and you said they probably just came broke your stuff jacked your shit and called it a day...... The more fucked up question is why the fuck is the fuckin ROOFER calling the pigs you on?? whens the last Roofer you met that was worried about illegal pot activity?? He must have been a employee of the apartment complex......

Ya I don't get the roofer thing. I used to roof and most of the people were cool. The landlord's excuse was the roofer needed to close the windows to caulk them. So he just let himself in.

Anyways here's the update. We found out how serious the charges are because the lease-ee has just been arrested on felony charges and supposedly will get out in the morning. Lease-ee has a squeaky clean record I mean nothing, maybe 2 speeding tickets. I'm trying to find out what exactly the charges are but the jail isn't answering the phone.

How the fuck is a lamp, bag of weed, seeds, and a scale a felony though? In ohio it says it isn't a felony unless you have over 200g.

I'm not sure how they got a felony out of that... I guess your friend will tell you what's up in the morning...
Hopefully nothing will stick and they didn't talk...

I just talked to my friend and the felony is due to distribution charges because of the scale I think. Shit will probably get dropped to a misdemeanor though. Young female white college student that works and has kids and has never been in trouble before. I don't think they'll be harsh on her.

this happend during the week of the hurricane.... the house is literally in the middle of nowhere
power was out for four days so 4 vegged plants and 1 seedling were moved to a room with a window in which the girl pointed out to the cops.

search warrant was executed ... plants, fluros, an HID, small scale and less than a g of ganja was found.
medicine bottles with my name on it were found, along with a fluoro box with my gf's name on it.
a warrant was issued, we were questioned in, another state, at our work .....we claimed we couldn't talk without lawyers.
turned ourselves in (WITH OUR LAWYERS), didn't answer any questions ...now they threw intent, conspiracy, simple poss., and poss. of paraphenalia at both of us.
.....i know the fact that the plants were moved to a windowed room was THE WORST MOVE...
sad part is ..my girl is being charged and doesn't smoke at all ...
you can read this story and see where i went wrong... but i can't stress enough one simple mistake

ataxia yeah it's shit like that you wouldn't think in a million years would happen. I mean it's a third floor apt who the fuck is gonna look through a slit in the blinds 30 ft off the ground. I hadn't been there so I didn't know roofers were working or the blinds woulda been completely closed.

Bit of good news though, lease-ee was released this morning on SOR. So they are already playing with the kid gloves.

i know ...i know .. like i said there are sooo many more details that could've saved me .... the fact that the people upstairs shared a common door with my place ... the lease was verbal so there was no evidence of that. there wasn't even furniture in there since we hadn't lived there yet.
A lawyer was the first thing i did before a warrant was even issued.... i managed to get one of the best lawyers in my area thankfully. I had to. as long as you and your lawyer have an "honest" understanding between each other they will work with you. in my case i got pretty lucky ...he ended up being a thousand less than others i had talked to, but that's because he represented me in a case of simple possesion and got me off with a 25 dollar fine. dude is gooood shit. I just hope he comes through for me now..

the moral of the story, make sure nobody, including roofers or hang glider pilots or anyone else can see your plants.

i cant belive roofers snitched, from my experience most roofers burn and do lots of other drugs

Here is what a lot of people are misinformed about, it doesnt matter if someone was robbing your house and found plants and called the cops, there is not a damn thing you can do about it. Private citizens are not bound by the constitution, the govt is. If someone told the landlord they saw plants they have every right to let the cops in.

actually your landlord is not just any private citizen. they are bound by the landlord tennant laws of your state and/or county/city. most places have laws which protect renters and landlords alike. most of the time there are explicit laws stating when and how a landlord may enter a rented home. in addition to these laws, often times the landlord will add specific clauses in the lease which pertain to these laws. the lease is a contract which must be adhered to by both parties unless specifically stated in the contract, both parties are also bound by the local landlord-tenent laws if there is a violation of such rules, then a civil suit may be in order.
