Man, sorry to hear about your arrest but very happy you got your freedom. Glad you beat the G but it's never cheap is it. Makes you wonder when they do this kind of thing, knowing the outcome down the road, if it's just to fuck with people. It only really ends up costing one person. It turned your life upside down but it was practice runs for them.

I don't see that happening anytime soon. I have EVERYTHING up for sale on Craig's List. I'm working on a 1983 lawsuit now. When that cashes out I'll let them finance my next grow. I no longer live in that area as I was advised to move immediately. My attorney says I POTP - Pissed Off The Police. I filed bankruptcy and let the bank have everything.

Here's some additional information.

With regards to a C.I. - ANYONE can be a C.I. BUT in order to use a C.I.'s information to secure a warrant they have to meet Aguilar v Texas' requirements. So this person was a snitch and not a C.I.

READ THIS:

Aguilar v. Texas, 378 U.S. 108 (1964), was a decision by the United States Supreme Court, which held that “[a]lthough an affidavit supporting a search warrant may be based on hearsay information and need not reflect the direct personal observations of the affiant, the magistrate must be informed of some of the underlying circumstances relied on by the person providing the information and some of the underlying circumstances from which the affiant concluded that the informant, whose identity was not disclosed, was creditable or his information reliable.” Along with Spinelli v. United States (1969), Aguilar established the Aguilar–Spinelli test, a judicial guideline for evaluating the validity of a search warrant based on information provided by a confidential informant or an anonymous tip.

I'm baaaaack.........

I disappeared in May of last year after I got busted! Fortunately for me they failed to get a warrant when they came in to my home. I was on a $40k bond and eventually The DA dismissed the charges without presenting them to a grand jury. There is this little known thing called the 4th Amendment and luckily when they arrived I had NOTHING growing and they found a handful of leaves in a trash can outside that I had not emptied yet. Other than that I was in between grows and EVERYTHING was broken down and put back in the original boxes. The 'secret garden" was EMPTY. I shit you not.

It all came down to 4 simple words when they appeared on my front porch for a knock & talk. I DO NOT CONSENT. Those 4 words kept me out of prison on a 25+ year sentence.

I know this is a skeptical group of people here so I offer some links from my postings last year. I'll also post some pics I took today when i went and picked up everything that they confiscated on 5/9/2012. It cost me $12,500 in attorneys fees, I lost my brand new home, brand new 5 series BMW and a new 2500HD truck. I filed for bankruptcy and lost EVERYTHING in the process. But I'm FREE!!!

I'll also post a picture of the dismissal paperwork for the skeptics who will call bullshit on this story.

Holy Bat Shit you paid your life savings, moved and lost EVERYTHING for them finding a few leaves and you are defending how right you are?

So you spent 25k+ on equipment but never sold a gram's worth. Got it.;-)
You lost your "brand new" home, your "brand new" BMW, your "brand new" HD truck. Sounds more like you were a basic grower/dealer and you got your ass popped. Being your "only my second grow" happened in March of 2012 and you were busted a month or two later, you sure didn't last that long. What this tells me is there WAS DEFINITELY A CI. There is no way they would be on you so quickly any other way.

How else did you make money that you could afford a new home and two autos worth 40k+ each? This is what confuses me. You are a newbie basically, your own threads and words prove this on here, yet you came into all this cash I'm assuming suddenly to buy not only the home and cars but this 25K+ setup. Could that have been a partial factor in the police getting interested in you?

You also talk about working on a 1983 lawsuit. To me this means you are in the business of suing for a living, another possible factor into why you may have been busted or had been on surveillance in the first place.

Your story to me seems interesting but strange, I imagine there is much more to the story and your post for me just creates all kinds of questions rather than creating the responses you had probably hoped to get on here.

Is there an actual point to your thread other than trying to find someone to buy your equipment? Seems to me buying any grow related items from you would be asking for trouble. Maybe drop that price in half. Good Luck.

I worked in sales for the largest medical device manufacturer in the WORLD. I held this position for almost 10 years and was very successful at it. My last full year of work I earned $347,000. I bought the house about 1yr prior to the arrest and the BMW was purchased just after that.

I posted this in an effort to educate you guys. Take what you can from this and learn a lesson. Either way I don't really care. I strongly suggest everyone of you do a security evaluation and have a contingency in place. Understand what can and cannot be done on a knock and talk. your 4th Amendment rights and INVOKE THE 5th if you ever find yourself in my shoes.

i agree.. some people are super comfy with their grows... even in a legal state you can still get fucked over

Not that easy. A warrant requires probable cause. They only had reasonable suspicion. And that won't cut it.
I would pack my shit and leave that state today. Not tomorrow. I got in a little trouble in another state every time I left the house I got pulled and body searched. I left and never looked back. I also changed my life style.

While i agree with alot of what you said, come on now he sounds like the type to sue for a living?

Its bullshit. He was illegally detained and searched through all his private belongings. What gives them the right to invade his home without the warrant? Then he HAD to pay a lawyer and because of loss of time and money from going to court BASED OFF NOTHING but cops not doing there job, had to claim bankruptcy on his frigen home... so he was guilty until he payed someone to prove his innocents. He deserves money and retribution. Maybe if the law was upheld to cops and feds they would do the PROPER paper work and abide by the guidelines put in place for a reason. But hell, its only our tax dollars paying there salaries.

To the OP, get used to it... people will always for some reason think you made everything up. People will always talk shit. Your lucky they did not have a warrant an still entered. Dea usually would want stuff to hold in court cause they do this for living. Maybe they wanted to get you paper off their desk knowing it was small time for them an wanted to scare you out of it. Who knows. Atleast no jail time and good luck with court as you deserve it... even if you sold grams to 10yr olds. They came to you unprepared and that is on them and there shoudl be repricussions for what they put you through.
