And what you would basically be doing is challenging their existence. So they will become frantic and angry and pretend that you have no merits and try to get the case dropped. And you might have to take it to multiple courts, possibly to the Supreme Court

If no one else will do it, I'll do it after the lawsuit I have now against the city here.

But whoever does it will have a famous Court case called [Your last name] V DEA, or V United States. And people will cite it in every Intoxicating Liquor case in the future.

And Congress could write an Act, or rewrite the Controlled Substances Act, to make solid substances illegal, such as Pills or things like Heroine. But they will not be able to write an Act to make Intoxicating Liquors illegal (again).

But you just have to make the point that the Federal Government is not allowed to Control Intoxicating Liquors, States may control them, as per the 21st Amendment.

They will also try to say that they have a duty to provide for public safety, and your rebuttal would be DUI laws which allow Alcohol consumption, but not driving while drunk. As well as things like Heroine Injection centers, which keep people alive and from getting diseases. Then show the statistics about how the Controlled Substances Act has increased both the price of drugs, and Cartel activity regarding drugs. Proving that the Controlled Substance Act is hardly the only way (and probably the worst way) for the DEA to provide for the Public health and safety.

In my lawsuit against the Police here, they claimed that I claimed only a 14th amendment case, and ignored the religious part completely. Then said that there is no jurisdiction for the PD to be sued, then requested the case be removed to the Western Texas District court.

Lol. All I have to do is walk in to the courtroom with something explaining my religion, such as a notarized article or research paper or book excerpt.

Then the definition of government from Tx code Title 5 chapter 110

CHAPTER 110. RELIGIOUS FREEDOM

(2) "Government agency" means:
(A) this state or a municipality or other political subdivision of this state; and
(B) any agency of this state or a municipality or other political subdivision of this state, including a department, bureau, board, commission, office, agency, council, or public institution of higher education.

I went to court for a Traffic Ticket Yesterday, I had 2 and one got dropped, I am going to take the other one to Federal court. The one that got dropped got dropped because the cop didn't show up as a witness.

I submitted this to the judge and he said just file with the County Clerk.

And the Prosecutors started talking to someone else then he went back and sat in the crowd and I had talked to him when it was just me and him in the court room, so I said "If the cop that gave you your ticket isn't here, it will get dropped".
Then the Prosecutor walked up to him and said "The officer who gave you the ticket said you were..." and I whispered "Hearsay", and when he walked away I could tell he didn't like that. :lol:

I'm excited about this lawsuit.

They are still in possession of my Property with no charges filed, and no charges that can be filed. I think they are just keeping it because they wish they could file charges and they are working as hard as they can to find a way, but there is not a way. Everything I had was legal.

But they are just holding on to it, for more than 3 months now. And they are trying to say that there is no jurisdiction to sue them because they are part of the city, and that I have no right to an illegal search claim. So in their counter filing they completely ignored the fact that they violated my religious rights, and continue to do so by holding on to the property.

And their response is just saying I don't have Jurisdiction and that I don't have a Illegal Search claim, so I just have to bring up Tx Code Title 5 Chapter 110 which puts them under the Jurisdiction of a Lawsuit and waives Texas' Sovereign Immunity in Federal Court. So it's funny that they say they are immune to a lawsuit because I don't have Jurisdiction, because not only are "Departments" of a "Municipality" suable, they have waived Sovereign Immunity in Federal Court. So Federal Court should be fun, they don't even know, they are just trying anything they can.

If I ever have to go to court again, I think you would make me a great lawer for if they read all the shit you would throw at them they would die of old age befor it got to go to trial..ky

If you actually read everything in there and start to get an idea of where everything is, when different things happen in the court room you can pretty quickly flip to the page you need, and cite the case you need. That 144 page document assumes that your publically assigned lawyer is going to work against you, the judge is going to work against you, and the DA are going to work against you, and it gets you to a point where you will still win. Especially in a Religious Case.
