Illegal Arrest: KNOW YOUR RIGHTS
“An illegal arrest is an assault and battery. The person so attempted to be restrained of his liberty has the same right to use force in defending himself as he would in repelling any other assault and battery.” (State v. Robinson, 145 ME. 77, 72 ATL. 260).
You don’t have to run when resisting an illegal arrest:
“When a person, being without fault, is in a place where he has a right
to be, is violently assaulted, he may, without retreating, repel by
force, and if, in the reasonable exercise of his right of self defense,
his assailant is killed, he is justified.” (Runyan v. State, 57 Ind. 80;
Miller v. State, 74 Ind. 1).
If you see someone being arrested illegally, you have the right to:
“One may come to the aid of another being unlawfully arrested, just as he may where one is being assaulted, molested, raped or kidnapped. Thus it is not an offense to liberate one from the unlawful custody of an officer, even though he may have submitted to such custody, without resistance.” (Adams v. State, 121 Ga. 16, 48 S.E. 910).
Up to the point of:
“Citizens may resist unlawful arrest to the point of taking an arresting officer’s life if necessary.” Plummer v. State, 136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John Bad Elk v. U.S., 177 U.S. 529.

yea you might be right as far as thise cases and hearings go but you know as well as everyone else that cops can lie and easily get away with it. happened in my home town a couple of months ago, a man was killed by cops because he was "resisting" arrest but there were a number of witnesses and there testimonies went unnoticed. I agree with your thoughts on resisting illegal arrest but doing so might end you up in more trouble than origanally. cops have to much power for themselves, dont let cops push you around but dont let it cost your life for something simple.

My experience growing up in ghetto ass Long Beach, you do what the cops say and have your day in court to prove you're innocence. Even If they are In the wrong do not fight and do not resist, I have walked that path In my younger day's and It's the worst decision to make. Use your verbal skills and be respectful and I guarantee you will get the same back from them.

yes this is what I leanred too, you let the cops do what they want and you keep your mouth shut, then you can choose to fight it or not...
Ive also learned that if you dont act or talk retarded to cops and try to be all tough and shit, and you let them know that you are intelligent and know your rights and you can call em out on anything they didnt do right during the arrest, you can sorta make em feel dumb, while still being "respectful"...which is a big thing for cops, they need that respect, so give em fake respect, they have big false senses of authority.

Yep, I worked custody for a local Sheriff's department for 1 1/2 years so I know all the radio codes. Whenever I get pulled over I fuck with them and talk in code and they're like WTF, It's pretty funny.

there are other vids of that shooting that show it from better angles, and you can see the cop pull his gun out and intentionally fire, and then everyone is in shock even his fellow officers...its fucking sick. I hope that cop does life in prison w/ no possibility of parole.

Holy shit they shot that dude in a public train station! With witnesses and everything. Thought I'd never see a clip like that. Um, yeah jst be polite and don't give them a reason to shoot you. Once you get to your lawyer do what you feel. Stay safe everyone. Peace!

cops want to kill you. they might say that they never want to but they chose a job where they are way more likely to kill a citizen. they train for it all the time. they shoot motherfuckers for driving a car near them . ive seen video of a cop jumping onto a hood of a car and executing the driver. they love it and they get away with it.

that being said, the guy involved in the bart shooting thought he was shooting his taser. as much as i hate the cops, i d believe this. but it is a good example of how cops will kill you on accident. so when they arent trying to kill you you have to watch out that they dont accidentally kill you. with all this killing going on it makes me wonder why we dont just kill them?

With all their training, I find it difficult to believe that an officer doesn't know the difference between his fuckin pistol and a taser. (no disrespect to you, mike, with the swearing. I'm really pissed that a cop would do that)

I've had a couple run-ins with "law enforcement" and I'm not one to get pissed off, so I'm usually polite and I've never had trouble. I had a zip and a half one time when being pulled over for speeding (Idk if he knew how much it was) and all he told me to do was "throw it into the wind". Nice guy.

you know whats funny I have 2 flowering plans growing and 2 seeding plants. Today 2 cops came into my house( I live in mass) and nothing happened altho you can def smell a faint stench of pot.( I love it) that basically makes my house like super man but with out a kryptonite

no disrespect taken. its like a carpenter who uses tools all the time. then one day wham, he shoots a nail gun into his hand. i dont think that cop was dumb enough to shoot the dude in front of everyone while he was laying down. im not saying it isnt possible. i just dont think so. i think you have a person who is not too bright. in a stressful situation. those taser are designed to be held like a gun and fire with the pull of a trigger. the other cops say that he warned the suspect he would tase him if i remember correctly. there is no one here who hates the cocksuckers more than me. i cant even tell you what i went to tell you because i have to protect my identity. i think the citizens should rise up and fight these guys back. i am excited to see a cop die on video. it makes my day. every time i see police brutalkity my soul burns with anger and my pulse rises. i have been a victim of their abuse of authority many times. i have been taken away from my family by these motherfuckers all the while i have never made a victim of anybody.

so it is not that i dont want to see him die a slow painful death its just that i do believe that this stupid fucker thought it was a taser. i think this is a good case to show people what kind of pieces of shit idiotic mothewrfuckers are doing police work. i think there is a negligent manslaughter charge to be had. but just watch, they will try him for murder. there will be reasonable doubt and he will get off. then what are the odds that they will try him for something that will stick? he will walk away while an innocent civilian is dead.

if it were my family member there would be no need for a trial.
