Illegal Search and Seizure? 4th amendment?

The smell of Marijuana is known as reasonable suspicion which in these United States is enough to warrant a search of a vehicle.

I've been pulled over a handful times and search for weed, I'm not sure if it was a state, county, or a city thing, but even though the cop smelled weed they had to get a dog both times before search my car, I live in ohio and it happen to me in tennessee once also, again, they had to get a dog before searching my car (i didn't have weed that time, but the dog still triggered, it was some bullshit, but could've been residual smell. That time they found my pistol that I didn't tell them was in there (it was in the trunk, not up front), and they took it and i had to pick it up a few weeks later after it came back that it wasn't stolen. That time in tenenessee i didn't get a citation or anything, I thought i was going to jail (for the gun) and they sent me on my way with a receipt so i could pick it up, once it came back not stolen. he also informed me they'd put a warrant out for me if it was stolen, but he also knew I was driving through, so, idk, pretty cool cop I would say. Pretty pissed at that fuckin dog though.

EDIT: also the last time i got busted with possession and I was driving, they gave me a fuckin DUI, too. That was some bullshit.

Pretty much if they smell weed and feel like searching you, they will. A cop busted me when I was a kid, me and my car didn't smell because I had my bud in a prescription pill bottle and I don't smoke in the car, but he said it smelt like weed so they kinda can do whatever the fuck they want if they smell weed or not. They only take the chance if it doesn't smell if they are 100% positive you have weed or else they would look stupid.
 
A pill bottle won't contain the odour of stinky weed!!.. I laugh my ass ass when ppl deny any odour when I can clearly smell it.. Just because your nose has become desensitized doesn't mean that there isn't an odour detectable by a newcomer to the scene..BTW, for all the greasy hippies out there, the same thing applies to body odours..

Some pills bottles might not, there are a lot of different kinds, but the ones I use actually work. And I have eighth top shelf jars to use too that are air tight and same with dozens of mason jars I have that also work fine.

Edit: I have common sense dude. lol. I'll be gone all day and not smoke, and then come home, take out the pill bottle, and I smell nothing in the room, the drawer, or even when I smell the pill bottle. I do smell weed when there is the smell of weed. I laugh when dumb people like you think they know everything. I'm only 19 and i'm positive that i'm more experienced then you, smoking and growing.
 
fuck that I'd fight it they can't charge you anymore and the cop will have to take the day out of work and you just might beat it

What I should have done was lock the pipe in the glove box and eat the weed but I wasn't thinking clearly. Also had a video camera in the car that we forgot to turn on, they hate being recorded...

never plead guilty to anything. I didn't see this post yet but its gonna be on record the judge will see a guilty plea on that next time and the cop might not have even showed up and maybe even beat it

Yeah man I know, I didn't plead guilty, I plead no contest, as in nothing that I say will get me out of this but I'm not admitting to shit.. I live in a small town and the cop would have been there.. He found it in my back pocket soooo

Here cops get overtime pay for appearing in court.. I assume that's the norm.. If they didn't get paid, everyone would walk.. Needless to say, cops love court..

Lights not probable cause for search, just for stop, but odor of pot is.

bad thing about that is cops can make up they smell it and then if they find something bust u even if there was no smell and how a month later when u go to court can u prove car didnt smell its a no win big win for dirty cops
 
I have a buddy who looks like he smokes weed, but doesn't (never has in his life), and he's had his car searched several times because the cops 'smelled' something.. It's a get out of probable cause free card for the police..
