This is just the kind of story I needed to hear to confirm whether or not buying seeds online was safe... I was contemplating it, but I am def. not even gonna bother now.
It is safe just dont use your address or your credit card.

But damn man I feel for you, why dont you go get the bags from the field though so they have no evidence incase they do find them.

yes it should be safe if you do not use your personal info...like my dumbass did.

i have really thoughjt hard about going back into the field to get everything, but i am so paranoid now...i dont know if i should....i mean do you guys really think they could use that for evidence....if they went back the next day? For all i know one of my neighbors was growing and saw all the cops at my place that night and he decided to discard his stuff in that very same field...what they find could be his???????

or do you think i already opened my mouth and said enough for them to use it against me? i was hoping a praying they were just using the chopper to verify i dont have a garden in the field...but who knows?

i do know this...if they did go back the next day...and i do get a court summons for charges...I WILL GET A LAWYER AND FIGHT IT:hump::twisted::twisted::twisted:

Yeah I could use a friend's address but still... Who wants cops comin to I their house even if you don't have anything to hide? Just a pain in the ass. I would feel bad if that happened to one of my friends just because of me.

Here's a worst case scenario for you to think about gWeese but it could happen easily.

They do go find those plants. That's what that chopper was for I imagine. Either that or they were looking for outdoor cultivation as well. Let's say they find that bag but can't tag it to you. It with everything else might be enough for them to come into your home once again to search. This time they take your computer (which I am astonished they didn't the first time because that almost always goes when a home is raided.) They access your computer, the sites you go to and then start reading through your posts including the ones on this topic that talk about how you dump that stuff in the field. There you have it, they tie you to the stuff in the field and now you are busted for that as well.

Just a thought.

They can use your computer to see what correspondence you've been having, what websites you visit and all kinds of other information about you. Checking people's myspace accounts is pretty standard as well. People need to watch out what they are saying in these forums or even visiting them at times if it relates to a crime they may be investigated for. They may be able to access information through your computer, cookies, saved passwords etc and maybe in other ways as well.

It may seem a little paranoid but don't underestimate their desire to get someone for a bigger bust if possible. Heck, when they are making drug buys they might even try to get someone to meet them in a parking lot across for a school or playground just to get your in more trouble and/or eligible for a mandatory sentence.

The only time I've ever been busted for marijuana was when I was on a canoe trip down a small but fast stream in the middle of the Mark Twain national forest in the Ozark mountains. My wife and I and a couple that were our friends stopped on a small gravel bar for lunch. I decided to light up and my paranoid wife thought we should go up into the forest a little way to do that. I exclaimed, "we are in the middle of bum fuck nowhere deliverance country, who they hell would be out here at this spot on the river to watch us?" and continued to puff away.

Sure as shit if there wasn't an eradication team across the river in camo with cameras, guns and binoculars. While some covered, two other crossed the stream in a motorized river boat, rammed our canoes as we were getting in them, jumped out and busted us. Luckily I was able to claim the small amount we had and was the only one to go down for it. I figured that was the least I could do after shooting down my wife's more careful approach.

In that deliverance town, while he was taking me to a cell, the toothless jailor was telling me how dangerous that stuff is and how it kills people. Really the only lethal danger I ever put myself in was that I drew people with badges and guns to me and I was more worried about this freaky jailor getting me in the butt than anyone I would possibly be locked up with.

I didn't get a lawyer, I plead guilty, prosecutor tried to get me 30 days in that mangy Ozark dungeon of a jail, but luckily the judge suspended the sentence, gave me 2 years unsupervised and told me to never come back to their county again. I have no problem with that last part at all, but I thought the prosecutor was a real asswipe and learned to never ever ever go to a criminal court without a lawyer again. I was pretty young and naive back then.

Sorry to get off the topic of this thread but I just wanted to make a point from my own negative experiences about taking just a teeny extra effort on being a little more cautious about things when you can. There's that one time in a hundred that it just might help you out bigtime.

Ordering with a credit card to your home is not such a huge bad idea, compared to ordering to your home when you are engaged in felonious activity especially growing!

If you order and don't have anything going on, well they can't even charge you for possession if you don't get it.

Knock-and-talk followed by wait-and-watch is one of the oldest tricks. They tried the same thing on me over 20 years ago, they said they'd have a warrant tomorrow. Next day I came home from school and the cops are outside all right, a dude in a suit is holding an old monster army-style walkie talkie with one hand while going through my garbage with the other. That was all.

If they could have gotten a warrant they would have come with one in the first place, and would have busted in your door instead of knocking on it. They had the seeds and they probably clocked your meter and they still couldn't get one.

Hope the silence from the judiciary isn't due to waiting for the grand jury to convene. Best wishes. If worse comes to worse, pay for the best lawyers you can. That's how it works.

thanks Kurtz...i definitely couldve handled it better...but i also do beleive they couldve gotten a warrant for simply saying they smelled burnt mj when i first ipened the door....so with my panic attack combined with believing they would be back....i did what i did. definitely a lesson learned the hard way

Dude,

Just wanted to say sorry you're going through it, but also thankful you've posted your story. Hoping the best for you in this bullshit age of prohibition.

Okay, so this has been a week now and they have not sent you a criminal summons? I don't know and am not an expert, but I don't think much is going to happen. I do know this: my bf got a criminal summons in the mail, but it came within a couple of days--not even a week. If you have not heard anything yet, I'm really wondering if anything will happen. But, you also said that these were state police, not the small town guys. State police are generally speaking a lot more professional than the small town guys, so I can't see them making big mistakes. dunno. It sure is puzzling.

I would imagine your nerves are shot at this time, but just try to relax. The more time that goes by without a knock on your door or a summons in the mail, the less likely it seems that something is going to happen. The state police don't fool around like the other guys, so my hunch is that if they could have done something, they already would have.

I feel for you, for sure. And it's a lesson to me as well. No ordering seeds online. Not for me.

Wishing you the best.

see, this is the shit that makes me not wanna buy seeds, ive kept from doing it, and ive thought about it, believe me, it crossed my mind, and then in the back of my head, i think ....where the fuck would i send em? and whenever they get there, whoever is there will probably get arrested, or some shit would happe, and id never get my seeds, or some shit that u always hear about....this is why i have alot of hippie friends, who find me shit, no internet to deal with. if there was a shop that i could go to, i would do that, i never ever buy things from the net. lesson learned eh?

I think it's true that in all states, or the great majority of them, the odor is enough to do a search.

So, original poster? What has happened? This thread has had me just about sitting on pins and needles. I'd really like to know what has happened.

If they never summon you, never tag you with what could have been found in the field behind your house, you might even have a case of false imprionsment, since they 'cuffed you and put you in a police car. Did they ever tell you what they were charging you with? I believe that's necessary for them to do that.

Me? I'd probably be so freaked out and nervous that I'd never follow up on anything of that sort. Who wants more cops in their lives, you know?

If you're still reading this thread, please let us know what has happened. If they have not contacted you with a summons, then you might want to consider just relaxing and counting your lucky stars. If they HAVE sent you a criminal summons (and these are state police we're talking about here, not po-dunk sheriff's deputies), I think you ought to at least call your local chapter of the ACLU and talk with someone there. They have an entire division devoted to the so-called war on drugs.

Wishing you the best. Thanks for sharing your experience. I think we've all been sufficiently warned that (1) ordering seeds online is the not easy, no fear experience it has seemed to be and (2) NEVER LET A COP IN YOUR HOUSE! A pounding heart is not grounds for a warrant, ever.

And like others have commented on this thread, I think your attitude toward your gf is commendable. She made a predictable mistake, being intimidated by guys with guns, badges, 'cuffs, and scare tactics.

Let us know what is going on, okay?

I dont agree.

Maryland case
Police who entered an apartment after smelling marijuana being smoked there violated the Fourth Amendment's protections against unreasonable searches and seizures, the 4th US Circuit Court of Appeals held in a late January ruling. Evidence found during a subsequent search with a search warrant based on that illegal entry must also be thrown out, the court held.

the Utah Supreme Court held that the odor of burning marijuana is not sufficient to allow police to enter a residence without a warrant. The ruling in Utah v. Duran means that in Utah, police will no longer be able to use the old "I think I smell marijuana" routine as a pretext for conducting warrantless searches of homes.

article canada feb 2008 - The Saskatchewan Court of Appeal upheld a lower court's ruling that the smell of burned marijuana is not enough to allow police to arrest someone and conduct a warrantless search.

He smelled an odor of marijuana and was allowed to go in the basement where the plants, high-powered lights, fertilizer and other materials used in a hydroponic growing operation were discovered.
Allowed to go into the basement?

The first thing I would've done in this situation would've been the very next day went and seen a lawyer,( many do not charge on the first consultation).... just to see if the cops had anything on me, so at least I would've known exactly where I stood. It could be possible that the cops could be at fault here and a lawyer could tell you in a matter of minutes whether they are or not, not knowing and "waiting it out" to "see what happens" would eat at me, I'm the type of person that I want to know exactly what my options are as soon as possible.
