I was pulled over in the mall parking lot by Officer S. He said he pulled me over because the owner of the car (my brother) license was suspended. Then he said it smells like marijuana then proceeding in asking me if I hand any. I then handed him over my 1.8 grams of marijuana. The officer then asked if I had a medical card. I then handed him my licensed Medical Card. After I confessed all the weed was mine Officer S. repeatedly told me I was lying. Also he said I was delivering marijuana to my brother which was in the car. I did not consent to a vehicle search so they retrieved a warrant to search my vehicle. When searching the vehicle they found some paraphernalia throughout my car. I confessed it was mine. There were three officers present which were Officer M, Officer S and Officer Mac. It lasted from 10:30am- 12:30pm but the officer reported it happened at 11:50am-12:20pm. Even though confessing that all the Marijuana and paraphernalia was mine they still arrested my brother. In the end both of us were put in jail for possession of marijuana and possession of paraphernalia.

Sorry bout the bullshit brother. sounds to me like you were 100% in the right there. I had a run-in with the law 2 nights ago also.... I had lent my jacket to a girl who I didn't even know because she was cold and I had a spare jacket with me. We got stopped by the police walking outside while the jacket I lent her was inside her car. None of us had anything on us so they brought a k9 over and walked him around her car a couple times and then caused him to false alert. He searches the car and asks afterwards who the jacket belongs to. I at the time am wearing another HEAVY Carhart jacket, but I told him the jacket was mine because it was. He found a bubbler inside the jacket. Now he did not ask me once if the pipe was mine, just the jacket. He then wrote me a summons for possession of paraphernalia and left.... Would it hold up in court if I just tell them that I was obivously wearing another jacket so the one with the pipe was obviously being worn by someone else that night? The girl who had it won't get in trouble because its over and done with plus I honestly dont even know her name. Met her at a bar that night.

anything found in the car goes on the one in care and control...being the driver. they may just go to court and say your where the driver. and you cant dissprove it unfoirtunatly., your word against his..and we know who the judge will believe. good luck dood. all you need is to prove you where in charge of the vehicle.
so from how i read it your brother wasnt in the car???..so get him to have a notorized letter to back the fact he gave you the car and where fully legaly responsible for anything that may happen to the car or other..should work

I would go to area businesses and ask if they have any video. If you can show that they stopped you at 10:30 and not 11:50 as the officer stated, you have already won and can have that cops ass for lying. THAT would REALLY screw the PD because EVERY arrest that dickhead has made is now suspect. Definitely get a lawyer, if it happened as you say, it's a slam dunk. When looking for attorneys, get one who specializes in bad cops, not MMJ law. You have a card and claimed the goods, case closed. No DA will touch it.
