What I'm not understanding (and I know very little of the nuances of Cali state law on mmj), is that if no charges were filed and no one was arrested, the cops were only investigating POSSIBLE violations, why then were the plants taken instead of counted and documented?
If no crime was committed at that time, there was no cause to even take them.
Should there not have been a investigator on scene, well versed in the laws RE MMJ? Should that investigator not have made the decision that a violation had in fact been committed and someone arrested before taking the plants?
So........Screw them, I would think that something can be done. Politicians fear and respect voting power. How many registered card holders are there out there in Cali? I would think that their voting power would carry a good deal of clout if they were organized. Even at the State and local level.
I've got 240 flowering right now. Fuck em!
I do believe she's Canadian. They're much more intelligent, reasonable, and progressive up there in Canada, so it's not quite playing with fire. It's a shame the US is no longer a progressive country, because the opposite of progressive is regressive. Soon the right is going to have us regress all the way back to the dark ages.Wow, playing with fire.
Believe me, If I lived in MI, or any other legal state, I'd be one organizing MF!!Give your MI State Rep and Senator a call and make an appointment to see them face to face.
Would being a law abiding, tax paying, employed with the same company here in michigan for twentyfive year citizen never in trouble with the law until I became legally protected to grow my own affordable medication, only to have my attorney general decree otherwise, so that now im nothing but a pot profiteering criminal intent on destroying michigan and all of her children the second I made the choice to dupe the voters and took advantage of the sick when I became "legal" and was afforded the laws "protections", only to find out the trade off my end up being put on a state police list like a petophile, except remember i'm a law abiding citizen. Does that count as emotional distress?Intentional Infliction of Emotional Distress, comes to mind. I sued over it and won a landmark case...
Infliction Of Emotional Distress
When one person purposefully engages in behavior that is intended to and does cause severe mental anguish in another, he or she is subject to the laws regarding the intentional infliction of emotional distress. There are several factors which determine the extent to which a perpetrator may be liable in such a claim. First, the wrongdoer's behavior must be deemed as extreme and outrageous. If a person of average temperament would suffer emotional distress caused by the wrongdoer's actions, then those actions can be deemed as "outrageous." Consideration would also need to be taken for those individuals whose temperament is more sensitive or high-strung: in cases such as this, the standard for outrageousness can be lowered. Second, it must be done intentionally to cause emotional distress or with reckless disregard to such a consideration. Third, it is also helpful if the victim can show other non-emotional damages such as loss of gainful employment.
