Macomb Township officials try to stop Saturday medical marijuana festival

Macomb Township on Friday afternon filed a last-moment request to stop a medical marijuana-based festival scheduled to take place Saturday.
A rare Saturday morning court hearing was scheduled by Judge Mark Switalski in Macomb County Circuit Court to conduct a hearing on the temporary restraining order and preliminary injunction sought against the operators of the sixth-annual Harvest Fest on the grounds of the Austrian Society Cultural Park on Hayes Road, between 25 and 26 mile roads.
Township attorney Larry Scott said officials learned of the festival Friday and that festival operators failed to obtain the required special-event permit. The festival is scheduled to start at 10 a.m. Saturday.
Supervisor Janet Dunn and other officials instructed Scott to file the motion.
“When you’re going to have live bands and overnight camping, you need a permit,” Scott said late Friday afternoon outside the county courthouse in Mount Clemens, after filing the documents.
He said the sheriff’s office, which patrols the township, also was unaware.

“You don’t how many people are going to show up,” he said. “There’s traffic and noise. They didn’t have anybody assigned.”
The event could “create the potential for severe harm including but not limited to unhealthy conditions, violence, unsafe traffic conditions and other violations of zoning ordinances and laws,” Scott says on behalf of the township in court documents.
But Steve Karapandza, president of the sponsoring organization, the Macomb-Oakland Compassion Club, believes officials overreacted as the organization has not had to obtain a special-event permit the past five years, adding the MOCC obtained a $1 million liability insurance policy, as required in the contract witht he Austrian Society.
“This isn’t really a festival. It’s the annual picnic for our nonprofit organization,” Karapandza said. “It’ll be people in the age group 45 to 75 eating food, listening to music and sitting around and socializing. It’s not a go-all-night rock party.”
He said 100 to 150 people are expected to attend.
Two live acts are scheduled to perform – a guitar soloist and an Alice Cooper tribute band.
Also planned are about a dozen vendors booths, food, games and raffles. Alcohol won’t be sold, Karapandza said.
The entry fee is $15 for MOCC members and $20 for nonmembers.
He said the overnight camping was mistakenly advertised as available for another $10. He said about 10 to 15 MOCC volunteers are planning to camp overnight.
The MOCC educates, informs and provides support for medical marijuana use, Karapandza explained. Michigan voters approved the Medical Marijuana Act in 2008.
Karapandza, a Madison Heights resident who graduated from Fraser High School in 2000, said he has a medical marijuana card.
He said he learned of the legal action about 4 p.m. Friday while setting up tables.
“I was surprised,” he said. “I can’t believe this is happening. We’ve always been good, law-abiding citizens.”
Officials are concerned the event is similar to the Camp Out With Your Amp Out festival, a three-day music event featuring 40 DJs and live bands, planned for the same site Labor Day weekend 2013. The township filed a similar motion, and the event was nixed by the same judge because the operators failed to obtain a special-event permit.
Curt Kitter of the Austrian Society said earlier Friday afternoon he became a bit concerned because he had not heard from the MOCC for several months and not yet received a deposit for the $500 fee. He said the contract indicates the event supposed to end at 10 p.m. and did not include overnight camping.
At the hearing, attorney Matt Abel is expected to represent the MOCC.
Karapandza said he hopes the festival will go on as planned. He said most of the attendees will come from metro-Detroit but some will be coming from long distances in Michigan.
“I’m hoping the judge says we’re all right and we can have our picnic,” he said.
