My situation

So I looked through the marijuana act and couldn’t really find something pertaining to the situation. I am a registered patient and have a card issued to me however I recently quit smoking and took the card out of my wallet. I was cleaning out some of my old stuff in my room and was going to get rid of it. Because of living situation I threw it in my car(not in my trunk) not even considering it. There was a bowl as well as two very small joints that were more then half way smoked. I ended up getting pulled over. Long story short the cop gave a possession of marijuana ticket, I had all the paperwork from the doctor and even my paper that came from the state that originally had the card in it. But of course wasn’t smart enough to grab my actually card. Have a court date set and no idea what to expect or how to approach it. Any advice?

lawyer up. They are going to get a sense that you dont know what you are doing, and they will screw you in every way they can.

so was your card valid then or is it still valid now?

the law about putting bud marijuana in your trunk does not apply to medical marijuana patients. (but there is now a law about edibles)

go to the court house, with valid card in hand, tell them they need to stop prosecuting you immediately or you will be filing a hefty lawsuit against them.

if your card expired, you may need to fight it in court.

yes a lawyer would be better. a lawyer tat specializes in medical marijuana. do not get a lawyer unless he/she knows about that case about improper transport in the COA...

I have been screwed in court a couple times, BAD. Always because I didnt have a lawyer.

I actually got my card not more then five months ago. It’s defintey valid. I sent in for a new one today with all the paperwork so I can get a replacement. My old one is completely gone and a lawyer will be contacted tomorrow. The bill The was going to void out the transport of marijuana, did that already get signed in?

I'm not sure, but as long as you have a valid card, and a lawyer to keep "them" in line, you'll be fine. Do you have a record?

I think it mostly depends what county you are in. Some will drop charges if you get a card. Others do not care if you have one or not. Lawyers usually help unless you pick one the judge and district attorney already dislike.

I’ve never had so much as a speeding ticket, certainly never been to court which is why I’m so worried about it. I intend to also go to the courthouse tomorrow with all my paperwork and my info that I sent in for my replacement card and letting them know I sent in for one and no longer have my original. That or would it be better to wait until I have my new card? Just don’t know if it’ll be in by my court date.

it cant really hurt to ask without your new card in hand.
i'd also suggest printing off the news story about people v latz
and print off the current status of the bill to remove 750.474 from the books.

looks like it passed the house and will be read in the senate a few times before it goes to a vote , then another vote, then to the gov to sign... so probably not before 2018. but sometimes the legislature gets a lot done in the last week of december like idiots so who knows.

the card is a specific "you shall not pass" "get out of jail free" thing.

its hard for us to tell how it will go. like sun says above, some courts are better than others.

my advice is do not panic, you are safe 100%. call around to some lawyers and i'm sure one of them will do it for a simple fee (to the lawyer, not the fucking court), no conviction , everything off your record. maybe even return of your bowl. make sure to ask the lawyers about returns of property to registered patients. because you can and will get your property back. yes just to say fuck you to the court... watch the cop pass you your bowl back its classic on their face.

this wont be the time or place for a conversation like that. However, he is correct

Honestly, your documents should do all the talking for you. If you have a valid card and just failed to present it at the time of being pulled over and you had the items stowed away in the vehicle and following all local and State laws, than you should face no more than a "proof provided" ticket at worst. Likely nothing if you make a date to go in front of the judge. The prosecutor may decide to drop it before you even go in to see the judge once you provide proof.

I honestly see it going down just like Red said. In Michigan, you can even do that with a gun, if you forget your CPL. They give you a ticket, take your gun, and you have 60 days to present the CPL, then they give you your gun back.

Feel a lot more comfortable now. Thanks all, I will definitely keep you posted. My county is quite small which is why a lawyer will be contacted to see what to expect with something like this, help get an idea of how they view medical marijuana. They can keep it, wasn’t nothing but garbage and a whopping one gram officer was actually really nice just confused on the topic which is why he called the drug task force. Thanks for the article on the bill though, helps ALOT.
