Sully - patients need to be able to sell overage within the system as well. I can not support a system that continues to force me as a patient to give my overage away while caregivers are allowed additional privileges with their overage.
Actually if I read 1296 correctly, if a caregiver has excess they can "donate" it to a dispensary.

Correct. But nobody does that, and i'm pretty sure that nobody ever will. Dispensaries in Maine are unable to produce enough to satisfy the customers they have now. Do you really believe that they will take my donation and give it to a low-income patient who cannot afford to buy meds? I don't have that kind of faith, man.

Correct. Sully from MMCGM posted about their efforts to change this to which i replied that i would only support this change for caregivers if it would also be changed for patients. The only way a dispensary is gonna get any overage from me is to pay for it.

Anyone with the privilege of possessing cannabis legally should be able to sell their excess to any person or entity who has the same privilege.

but if you ammend it to allow caregivers it opens the door for later ammendments for patients. if you hold back on any, then you'll have a flood gate issue eventually.. like we are seeing with maine casino laws. since we have no laws in place, all they need to do is pass a voter reff. (which proves to be difficult but nothing after that) MMJ has the same problem, if you say no to this because its only partially you gain no further ground on your real purpose, which by the way, I agree completely with.

Just a quick note here, I am not with MMCM, I am with CCM :-). I just want to make sure there isn't any confusion. Regarding the idea of patients being able to sell their excess... that raises a very interesting point. The first thing that comes to my mind is, when a patient gets medications from a pharmacy (painkillers or whatever), they are not allowed to resell that medication to anyone, it is only for their personal medicinal consumption, right? I would think that the same would apply in the case of MMJ, meaning that only "providers" would be able to sell their excess for compensation, so it would be like one provider selling it to another provider (caregiver to dispensary). Just my .02

I don't think your analogy is appropriate. I'm not able to manufacture my own painkillers and therefore risk legal penalties by accidentally manufacturing more than my prescribed amount.. On the other, the pharmacy can get their supplies from any manufacturer they choose.

I think, if you want a right to sell your product , you should pay the state for that right $300 ...like everybody else...better yet , why should anyone pay?

I'm not asking for the right to grow more plants which is what the $300 buys you in my mind. Do you really believe that patients who grow for themselves should be put in the position to either risk jail time or have to give a product to a dispensary who will turn around and sell it? They cannot produce enough to satisfy their current customer base and when there is no oversight to ensure the dispensary will, in turn, donate the product to low-income patients i have no doubt that is what would occur.

It's not like patients have less skin in the game than caregivers. The concerns are the same for both groups - by following the limits of the law we are both bound to fall outside the bounds of the law.
