New ommp laws coming into effect

Do you grow for any number of people aside from yourself? If so, yes, you need to sign up for an account to report what you're growing, how much has been harvested, where it goes, etc (read the link there for the full text and search for PRMG. As a trade, you are allowed to have up to 6 pounds (indoors) or 12 pounds (outdoors) PER plant of processed cannabis (36-72lbs per patient you're growing for). If you are a patient growing for yourself (AND you don't sell any extras to dispensaries), you don't have to keep records and the limits are the same (36-72lbs). Also note, that now medical marijuana grows like recreational grows can NOT be visible by unaided view in public spaces (e.g. it can't be visible from the sidewalk in front of your house). Unfortunately for me that means I need to tweak my medical garden (I'm currently pondering either doubling up the 10ft pvc hoop house to make it ~18 ft tall or digging it down a few feet, thankfully I have more than a month, but digging it would just suck so this weekend I look into expanding the hoop house upwards and seeing if I need more greenhouse sheeting.)

Additionally, unless you're applying to be grandfathered and get in, you can't have more than 12 mature medical plants in a residential area (so no growing for more than two patients if you're in an area zoned for residential). There are a few other changes that will effect you if you're a grower so please read the bill @ http://www.oregon.gov/oha/mmj/Pages/rules.aspx and/or contact a MJ lawyer (there are seveal, I like Bear Wilner-nugent in the portland area, but really, there are loads.)

Thanks a ton for the post! I called my city zoning place today and i apparently am zoned for commercial so i don't have to worry about the 12 plant thing. Also when you say the grow can't be visible by unaided view in public spaces does that mean the building? I grow in my work shop for my family members and myself and i'd have to have a build a wall in front of it lol

Sorry, the can't be visible unaided is the plants themselves (or the processing of the plants) if you're an indoor grower unless you do your trimming outside, that won't effect you. I'm a fan of sunlight so I overly fixate on that portion of the new rules as indoor my yields suck ;)

Haha to each its own friend, sorry for asking so many questions i guess my only other question is about recreational permits. I have a friend that wants to get a recreational producer's license but wants it at his house (he has a pretty big shop) but lives in city limits and his place is zoned residential. Would that be possible? Once again thanks for all the responses you are truly helping me out alot

No worries, just remember, I'm not a lawyer, so (always) check with a professional before risking life and or bank account ;)

For a recreational permit, that's quite different, as long as the city doesn't have regulations restricting production of marijuana there is no reason they can't produce in a house. However there's a ton of leg work required (grow plan, estimated power usage, etc) have them check out: https://www.oregon.gov/olcc/marijuana/Pages/Recreational-Marijuana-Licensing.aspx but no, just the zoning won't cause them to be denied a permit (assuming the city hasn't zoned marijuana out of residential areas, or the city limits)

Really? I was reading some of the law and it specifically says they don't give recreational permits for places that have a primary resident in residential zoned area's. I will try to find it again and link it. Not sure if i'm reading this right but doesn't this basically say that you can't have a recreational marijuana business's primary location be your primary address (where you live the majority of the year)

(again, not a lawyer and haven't really read all the ins and outs since I'm medical) It depends on the person's situation. Say theoretically they own a small house in a residential area BUT don't live in it (or arguably at least don't live in it full time, so it's not their primary residence) AND they aren't using it as a grow site then they can be a producer at that location. Heck venturing further into theory: if they have a mid sized house and favorable zoning they could turn it into a two (or three) residence building that share a common wall situation (called row houses out east) then have a grow site in 1311 Main St and a second processing location at 1313 Main St But really, at that point it's ever so much easier to just rent two industrial locations near by as that's significantly less money and easier to move out of if the business climate changes...

Medford still has dispensaries, but they are not allowing ANY growing. There are a bunch of cities that are trying to cut off all growing, not even the 6 plants patients are allowed to have. Outdoor growing for sure, but some places want to ban any growing at all.

It is REALLY complicated. I hope the state starts crushing some of these ass-hat politicians that are trying to make an end-run around the democratic process.

Welp i guess i'm legal till the vote in Nov (i live in douglas county not in a city tho) hopefully they will vote against the law and allow me to grow my medicine
