my paystubs say "medicare tax" on them, not "medicare penalty".

usually, stuff that goes on my 1040s, like the mandate may if left standing, is what i consider to be a tax.
And that is why medicare is legal, and the individual mandate is not. Good job, Bucky, you're getting it!

If you can pay this new tax you should, it will give you the right to wait until you get sick to get insurance, and they can't turn you down for preexisting conditions.

You truly don't understand PPACA at all, do you? If middle class people opt out of the mandate and just pay their yearly fine, the system is financially untenable, it will be another "Democratic success story". PPACA depends upon the fundamental concept of insurance, spreading the risk over a large pool of people, if all the healthy people opt out then the pool will consist entirely of sick people whose health care bills will outweigh their premiums by thousands of dollars.

If the mandate gets struck down the whole scheme will collapse.

It will be preferable to do so, since it will be illegal for an insurance company to reject you for a preexisting condition.
