Pushing MMJ limits

Has anyone else been hearing rumors of people drastically pushing the legal limits of MMJ?

Many states have the caregiver arrangement in which a person can cultivate for 5 people but not sell to anyone else. And yet, I hear of dispensaries opening in these States contrary to law.

I have also heard hydro shops advertising on the radio as specializing in MMJ equipment. This while legal according to state law, is still illegal Federally. And Eric Holder is not going to step on the toes of the local Federal prosecutor if he decides to charge these guys under existing statutes.

I'm just wondering if it will only be a matter of time before these people find themselves in Court or if things will continue to blow up like they have.

I for one can easily see the MMJ laws over turned and the cops saying "we told you so."

Why can't people keep their shit on the down low and not fuck it up for the rest of us. These ass holes pushing it into the public sphere are going to lose the support of the public IMO.

How exactly does one open a dispensary in a state that clearly doesn't allow it?

i shouldnt have to be underground i should be able to plant as many as i want

Thats great - meanwhile we have laws that say you can't and they are something we must deal with.

Michigan for one. Any state with similar laws. Even in California they may be pushing the envelope of what is legal.

interesting topic, and i think there is an answer to it, what has happened lately with MMJ legislation
NJ has introduced a dispensary only law for MMJ
NY seems ready to do the same, dispensary only
the current thinking is this is in response to the 'uncontrolled' situations in Cali, Colorado
so instead of allowing personal grows, which don't seem to have had much 'public nuisance' visibility, these states are going to control a dispensary system
my opinion this is simply a bit of 'state stealth' to start small, its about the money on the sly
the genie is out of the bottle, and he's not going back in

From what I can tell Michigan law does not specifically state dispensaries are not allowed.
It doesn't have to. The Dep. of Health which is the governing body has made it clear.

Plus, the law as it is written is a "constructive" prohibition. A caregiver may have up to 5 patients and can not sell to anyone else. Nor can anyone purchase MJ from anyone else.

The only way around it would be to open one as a collective of say 100 care givers which would limit you to 500 customers. Then, each sale would be recorded under the respective caregiver.

But then again, the prosecutors office could charge you all with the full amount on the premises and conspiracy charges.
