Just a quick question, was wondering if anyone had any information about this.

Say you get caught with a bag, or get caught selling someone a bag. Do either of these instances give the police enough probable cause to process a search warrant for your house?

Yes it does, but they can only search your room and belongings and not anyone elses unless of course they have information stating other people at that property are involved.

assuming you're not on your property when you were arrested, I would think an arrest for a single small amount sale/possession is not p.c. in itself for a search. If you had a paper in your wallet detailing numerous sales to customers or a grow room diary or 10 credit cards in other peoples' names, etc, then that's something else. This is in USA

if you've ever been in trouble you'll already know its guilty until proven innocent in real life.This may be the USA but they make the rule book up as they go

I live in the USA, thanks for the info guys.

What if the house isn't in my name? Would they need permission from the owner? I know most of these questions no one really knows the answer to, but it's nice to get some opinions before extensive research, gives me ideas on where to look.

In the UK they can go back to your house within no time of arresting you. This was the case years ago and is the same today. It literally takes them (the CID) minutes to obtain a warrant. Don't sleep with your work if that's what you were thinking.

It depends. On the facts/circumstances, and most likely the State. If you happen to get busted in your car with a small baggie of weed, there is no probable cause for them to obtain a search warrant to search your house. If you tell them you obtained the weed from the pile of weed you have in your house . . . then they likely have pc to obtain a warrant to search your house.

People get busted all the time with small amounts of weed - either on their person, or in their car. They never have their houses searched as a result, absent some really extraordinary circumstances.

But based on the facts you've alleged . . . no, the house would not be a candidate for a search.

If I were caught selling {depends on the amount really}, I think they would need a prior incident on record in order to have a SW issued, I would see the judge having a hard time believing that a dime bag being sold on a corner would equate to a house full of weed that's a big step, even for the law....but stranger things have and do happen, it is the law after all :mrgreen:

I always operate under the assumption if they want you bad enough they will do what they need to do to facilitate your arrest.......so I try not to give them any reason to get upclose and personable with me ..!

if you're selling you should already have a lawyer on retainer and try to avoid keeping anything on your actual property. if you have stuff on your property and this happened to you find a safe place to keep it and wait
