Urgent Question about Red Card

So basically my g/f works for a agency that doesn't take kindly to mmj users. Anyway long story short they are trying to fire her because I live at the same address as her and they pulled the mmj registry and saw her address on there. So that's why they are trying to fire her. Crazy stupid IMO but that's besides the point. My question is can I just go out and get like a P.O. box or something and change my address to that? Or any other way? I'm just trying to think of a way for her to keep her job and I feel terrible I'm affecting her like this so any help would be much appreciated. Thanks guys

ouch, sounds like a potential violation of HIPAA rights (Health Information Privacy Act). I"m curious where they got the database information myself, I didn't think it was available and personally, I think a big deal can be made out of it ... get ahold of the news/media ....

otherwise, I don't believe there is an issue with using a PO box that I am aware of. You can always contact the CDPHE directly and ask them. They also might be curious to know the story behind it, as it may be a rights violation issue as well.

Thanks for the quick response bro. Yea I didn't see anything on that website about using a PO box, btw thanks for the website it was very useful. I was going to email them and just ask, for lack of better terms, if it is cool if I use a PO box and see what they say. I'm sure they will let me know either way.

Yea man idk how they got that list either honestly. She works for the govt but I'm sure that the HIPAA acts still apply there. They obviously didn't tell her where they got it from or how and I'm sure it would take some legal work to get it out of them. Idk we are both just a little shocked and confused by all this.

I would contact someone like Rob Corry and threaten to sue both the state and her employer. A20 specified that the patient registry is supposed to be confidential, and that only CDPHE staff has access. Law enforcement can ask if a person is on the registry only if they need to validate legal patient status as part of a potential arrest situation. If your gf's employer went fishing in the registry, which it sounds like they have done, then they broke the law.

Ok for some odd reason I hate putting details on the internet but let me say that she works for the air force. Now she isn't in the air force, she is a civilian working for the air force. Do all these rules still apply to her employer if it's the all mighty government?

Yea she did. It was only a secret clearance but still a clearance. And I get that part honestly cause I'm former Army, specifically Military Intelligence (go figure), and I had a top secret while I was in. So her boss told her that if I moved out or something she might be able to keep it, so they say. That's why I was asking about the P.O. box because I mean I don't really want to move out and get a second apartment.

I'm still a little confused about how they got this "list" even though they are the government. It's crazy to me.

Yea that sucks man I had a TS/SCI when I was in and anything they could find to imply that you could be bought or blackmailed was a major issue from over-due bills to over due library books...insane

Well then, the plot thickens. I have no clue what boundaries there are regarding privacy and military clearances, if any. I do know the registry is SUPPOSED TO BE confidential. Cracks in the dike quickly turn to gaping holes and the flood is not far behind.

My card is up for renewal soon and once again I'm questioning whether I want to renew.

The only reason I have a hard is the small chance that I get busted so at least I have something to make me less fucked. However, when it comes to security clearances, which are on a Federal level, I have no idea what the consequences are. I would seek the advice of a lawyer ASAP or just change the address on the card (maybe to a friend or relative if you have one here?). This seems like the type of case that could go to the Supreme Court, which sounds like a lot of legal expenses. Either way that is some bullshit. I wish you well and let us know how everything goes.

First off they don't have access to the registry, even if they did it would be your name, not hers. Do you realize how many people have old outdated addresses in the registry? No one is going to go through all that trouble to find people living with people on the registry, do you know how stupid this all sounds? Your woman is feeding you a line of shit to get you to quit smoking weed, plain and simple.

I started reading this and nearly had a heart attack(I just got my card in the mail 36 days exactly BTW). Has she ever told a co-worker that you have the card? On the other hand, when I was in the Navy, they dug into some pretty old crap of mine that was to have been sealed as I was minor... So looks like you're getting a P.O. box. You only have to prove that you reside in the state.

Yea first to address the comment about her trying to get me to stop smoking, that is ridiculous bro. It's not even close to the truth. She is losing her job, having to get another job with less pay, I don't think she would just make that up to try and get me to stop smoking. Not to mention it's now turned into her wanting me to move out. So with that being said that's pretty much the update. Needless to say I'm in a little bit of a state of shock to be honest. I just moved to CO 6 months ago with her and I honestly have no friends or family up here. It sucks. But what happens, happens. I'm trying not to trip. So pretty shitty update and all because the stupid govt. So now I just need to find someone looking for a clean, honest, job having, car driving, responsible roommate type situation. How hard could that be? :/

Sorry to hear that man, I wish you the best of luck. I still think you two should at least consult with a lawyer. Still sounds illegal to me as medical records should be kept private and it seems like they found an unlawful way to fire someone. But then again, I have no idea the rights you loose having a security clearance...

Okay then she's using it as an excuse to get rid of you. NO company that is a contractor for the govt is going to have access to the registry, especially to the point that they can search addresses. And as I said before even if they did so what? Living with someone who is on the registry is going to get someone fired? Why in the hell would a company violate the law, waste money and time, just to see who's living with someone who smokes weed? This is getting funny.

You originally said they are 'trying' to fire her, how do you 'try' to fire someone? You either fire them or you don't. Now 2 days later you're saying she has to take a lower paying job? In 2 days she got fired and already found another job that is lower paying in an industry with security and background checks? Cmon man, wake up.

Address change. Chances are if she is working a job like that, it entails a contract of which would require such things. Not to mention the fact even though she is civilian, she IS working for the Federal government which again is usually a term contract and you are bound by federal laws in that case. State will not apply to a person in that situation.

My buddy was civilian contract down in the springs with his card, had a issue and to make it simple, feds dont give a fuck about you or your card, it has no affect on their laws.

I too thinks something is amiss, how on earth would they find yours/hers address on the registry? Did they search the registry via address? If you have recently gotten in trouble with the law, would your girlfriend be required to update her employer about her social status and maybe lose her job, or forced to take a llesser paying job?

Seems rather ilogical, not that the Feds are'nt; and if the story is true it sucks, but I'm sure almost any attorney would love a piece of this case!

just a thought ..... but I do know a couple civilian redcard holders that do a lot of federal type work involving some 'secrets' and there has never been a thought or concern from the employer (they do not know he is a patient). so either (a) this is a new issue in that the CDPHE registry database has been compromised and info has been slow to get to those employers, or (b) she is full of shit and trying to get you out of there, the redcard vs federal job thing is a great excuse.
