What if you live in a motorhome with your mmj patient wife-can she smoke while rollin

hello all! my question is this: my wife has chronic back pain (no shit, a porch rail collapsed while she was leaning on it & she fractured some things & has had back pain since halloween)--if she gets the medical mmj paperwork completed & we live in a driveable motorhome-can she smoke if its rolling?

granted that shes not the driver and im not rockin a massive contact-buzz (if thats even applicable?)

also what is the stance on being able to grow 5-6 plants in michigan if you're an mmj patient?

Well due to a ruling recently of the Michigan Supreme Court, THC metabolites present in a toxicology screen can not be considered so technically they currently have no way to actually test if you used marijuana so the main thing dont admit to being impaired, stoned, or even that you smoked marijuana in the last two weeks additonally dont act the role (dont be visibly impaired). If you do get pulled over the cop can use the smell of marijuana as a reason to search your vehicle and if he finds marijuana and he is a real dick there is a possibility he will take you down town but I would say that is unlikely in urban areas like flint or detroit but watch yourself in the rual areas especially as the cops really have nothing better to do and are jonesin for a conviction so they can get a promotion. If she truely is legal it wont be a problem and your case will be dismissed but if the cop is a jerk or your a jerk to cops dont be suprised if you/she end up spending a night in the county.

Remember never admit that you smoked marijuana they have no way to prove that you did unless they witness you or witness that your clearly impaired.

If she is registered by the state with MDCH she can grow 12 plants maximum after 21 days of sending in her doctor recomendation, application, and check if she DOES NOT receive a denial letter. This makes her technically legal to grow 12 plants and posses 2.5 ounces of 'useable' marijuana. However, some cops wont accept this unless she has the card which takes about 4 months to finally receive so again you or her could end up in jail untill your case is dismissed but you will not be convicted if your within the law. (IE its been over 21 days since she sent her stuff in, she did not receive a denial letter, she follows each rule accordingly (there are many I suggest you get to reading), and she is within the limits.)

When she does send her stuff in she should put you as A CAREGIVER - This allows you to posses 2.5 ounces and helps protect you in a lot of ways also.

she just slip back to the sofa/dinning room table/master bed to medicate, then
climb back into the passenger seat?

The law clearly states the 20 day rule, plain as day. The excuse?

the law doesn't say u can't medicate in a vehicle. it only says not on any form of public transportation. i would think that you would be protected under the part that says no one can be prosecuted just for being in the presence of someone using mm. Good luck!

LOL!! You can't be serious!!

i wouldnt get legal advise on these boards. but if you want mine, any and every cop will arrest you for driving with weed smoke in the vehicle, even with a card. also your not allowed to smoke in public. and rest area, public streets whatever, even if your in your (LOL) home on wheels. its still public.

Sec. 7. (a) The medical use of marihuana is allowed under state law to the extent that it is carried out in accordance with the provisions of this act.
(b) This act shall not permit any person to do any of the following:
(1) Undertake any task under the influence of marihuana, when doing so would constitute negligence or professional malpractice.
(2) Possess marihuana, or otherwise engage in the medical use of marihuana:
(A) in a school bus;
(B) on the grounds of any preschool or primary or secondary school; or
(C) in any correctional facility.
(3) Smoke marihuana:
(A) on any form of public transportation; or
(B) in any public place.

Dont smoke in your motor home while it is moving, it is not worth the hassle you could wind up with!

I suggest you get your wife on some medibles, they help great for pain and they dont stink up the place, medibles is the answer for your travels, remember they have to be labled now and all the other new stuff that just passed!

read the law, than read the new amendments, and than read it all again and again, it is easy to read, you dont have to be an attny to understand it, it is written in plain english, if it is not in the law that dont mean it is legal. alot of people think if it dont say selling to despeses is ilegal they believe it is legal, dont do that lol!

What on earth would make you even consider allowing ANYONE to smoke cannabis in an RV while going down the road? I couldn't even begin to think of how that could be justified.

Lock it in a box while the motorhome is moving or DRIVABLE. Park at night in a designated RV/Camping site, put a wheel lock on the steering wheel, and put the keys in a biometric lock box (and use a toe, not a finger so if checked you have some deniability concerning 'access' to the keys), and put out the awning. At least then you can say the 'home' out weights the 'motor' when you medicate.

That said, Phaque is on to something with medibles, but don't have them laying out on the table.

Sec. 474.

(1) A person shall not transport or possess usable marihuana as defined in section 26423 of the public health code, 1978 PA 368, MCL 333.26423, in or upon a motor vehicle or any self-propelled vehicle designed for land travel unless the usable marihuana is 1 or more of the following:

(a) Enclosed in a case that is carried in the trunk of the vehicle.

(b) Enclosed in a case that is not readily accessible from the interior of the vehicle, if the vehicle in which the person is traveling does not have a trunk.

well I beleive the reason people think they can have some one else medicate while on the road is because that is how we did it before the law!

I know I smoked while driving all the time before the law, I actualy am way more careful being legal than before the law, I figure shit im allowed to use mm as my pain med why do something to screw that up!

Plus these days as I get older I cant smoke mmj and drive, I get road trance and sleepy lol dont matter if its sative or indica or a mixture of both I get relaxed and can easily get in a road trance driving down the road!

Please dont have any one smoke while you are going down the road, I dont want to travel to your court case, and I may not go to your court case more than once if I dont think you deserve my support! I have been to alot of court cases in support of pt's and c.g's and will continue to go to the ones close enough to me to get to, just obey the law and I wont have to make a thread to get people to your court case to support you(not you dr. bob) but a pt or c.g that gets messed with by leo just for the heck of it!
