What's wrong with this story?

I was talking to a guy tonight that got busted recently. This does not add up to me. Tell me what you think.

He has a girl come over and smokes her out. She gets super paranoid, leaves and calls the cops and tell them that he has a lot of drugs in his place. Police show up and let themselves in after his roommate would not open the door (girl walked out the front door leaving it unlocked). They smell pot and make their way upstairs. The see some paraphernalia including a pipe, grinder and vaporizer. They then ask where the pot is and he says there is none. They ask for permission to search; he declines. They say that is fine we will get a warrant. Put him in cuffs and take him out to the car based on the used paraphernalia.

They get a warrant while he is in jail and tear his place up. They seized a scale, pipe, volcano, 3 bongs, cell phone with his dealers info, his personal stash which was 44 grams of pot (which is a felony in our state for possession and intent to sell both have mandatory minimums), and $1,880 in cash.

They hold him for 24 hours and swing the door open and tell him that he is free to go. No charges, no bail, no tickets, he literally walks out of jail minus the stuff they seized including the cash.

So what are your thoughts something isn't adding up to me?

Also I just checked arrest records, police blotter, and jail data all of which have no record of the arrest.

1. The girl got paranoid about what? Why did she call the police?That doesn't make any sense.

2. The cops can enter a home if they smell pot...but if they were already in the home, why would they need a warrant?

The only way you would get let go altogether for something like that is if the police did something wrong during the investigation. That is to say, if they thought that perhaps the search they did was illegal, then they could not charge the guy for what they found, in law it's called, fruit of the poisonous tree. Anything they would have found becomes inadmissable.

Or the other possibility is that he is a snitch, and gave someone up so he wouldn't go down.

some one flipped, your friend maybe, that girl almost defiantly. ill bet she got busted, and ratted your friend out, when he got busted he ratted some bigger fish out. thats what LEO make you do for freedom

She just freaked out and stormed out. He sent her a text asking if she was alright; she never responded. She called 911 what she told them other than their being drugs he did not know. A neighbor overheard her say something about assault; but the officers NEVER mentioned that to him.

Don't they normally wait for your lawyer to find the procedural error?

If he snitched would it be like he was never arrested? There is NO record of his arrest ANYWHERE. We have a local police blotter that has all arrests and his is not mentioned at all.

I know he got arrested because I saw the warrant and the list of items they seized as well as his personal property checklist from when he got booked.

i hate to pull this kind of refference, but...

didnt a rapper get busted with a ton of AKs and a giant bag of ecstasy? im pretty sure he flipped his gun dealer on the condition he keep the bag of rolls

but if this guy could prove he had all that cash in his house for a reason, they had to give it to him. i think the whole story smells like a rat, and i wouldnt associate with this guy if i were you

Not necessarily I guess. If the responding officers acted incorrectly, or illegally, and it is obvious that the defense would have had a slam dunk case, the DA would not even attempt to charge him.

I'm not exactly sure, I doubt it, but its possible.

they (the feds) wouldnt want this guy to have a record(it could have been part of the deal) so that his "boss" dosnt know he snitched and so his involvement is deniable, if not seeming like a surprise when Mr. BIGs door gets kicked in

The cash is legit. He has records of withdrawal from his bank and also collects rent in cash and has signed receipts from his tenants that pay in cash.

I am thinking he ratted on someone. This is the main reason for the post. I have a baby on the way and I don't want to be hanging out with this guy if he has a HUGE target on his back. Just not something that I want to be involved in.

i wouldnt chill with this guy either, some shit will probably go down and soon

when he calls, just dont answer, or just tell him you cant talk, dont let on that your suspicious by saying something like "things are too hot right now"

He doesn't know the wife is preggers. I think I am just going to tell him and say she is really needy / clingy.

I guess that is true. I just thought it strange that they would go through all of the trouble and not so much as write a ticket after waking the judge up to sign the search warrant.
