Yeah, I Have Something to Share

I work by contract and I get paid only when I produce good end results. My business is putting together business deals and for that I get 15% of any deal that my client and the acquirer agree to.

My job is to find companies interested in acquiring certain assets or properties of a business and make as good a deal as I can. Deals can take from 6 months to one year easy, more like 1 to 2 years for each deal.

We are, now, down to the line on a BIG deal and my client informs me, THIS MORNING, that he wants to cut my percentage to 5% or he won't honor the contract and he will do the deal anyway. Saying, 'You'll just have to sue me.'

Also, the buyers are one of the more powerful families in the country and they have silk-stocking attornerys. Attornerys that are now speaking directly to my client even though my contract clearly states that all negotiations and meetings will happen with me present.

This deal is big enough that at 15% I might not have to work again. But, at 5% I'll have to still work and hustle, just not as hard as before.

I'm so tired of swimming with sharks, but that is where the money is. I hope someone can relate, I feel... I dunno... used.

Sorry to hear of the crappy dealings. So many people in this world have NO moral compass.

They get money in them and there like a deer in the headlights.

All you can do is let karma take place, and it will in time.

Or you can plot REVENGE. Ha Ha no seriously I dont think that would be the best thing.

Hope things turn around for you, might want to look at not doing business with them again.

Already sent my attorney an email asking for his assistance. He's $475/hours - OUCH!

If it stops raining I'm going fishin' I need the stress break and I haven't been for years. I'll send you picks if I get lucky.
i'd call a lawyer for an opinion, at the least. ;)

yea, that is kind of pricey!!! That sucks!!! I wouldnt do business with "one of the most powerful family's" in the country in the first place because how did they become one of the most powerful fam's in the country?

by fucking people over just how they have done in your case... And if you have been doing deals like this for a while now, i think you can afford some high quality dank smoke to help with the stress... and yea contacting a lawyer would be in your best interest...

try to fuck them over with a breach of contract law suit or just take it as learning experience and let it go... like another fellow RIU'er said, karma will take care of it... When they least expect, bam testes cancer or something similar...

WHo knows, but assholes like that deserve punishment of the worst kind if you ask me...

Superb way off letting steam off, kicked back fishing, wish my wife would go fishing with me.

475 and hour, geez, there must be others that are cheaper. The one I seen was 150 an hour and I thought that was steep.

Sucks to be the little guy, but 15% sounds like a lot. Wait it out a little...you may be able negotiate yourself into a better position or trade some fee for equity in the deal

My attorney started out at about $175 and I've been with him for years. He has, somehow, won a ton of awards and cases. He likes to prosecute his own patents and he is very good at it.

He has represented me in the sale of my 3 patents. Sometimes, it is more about quality than quantity. Plus, he doesn't charge me for every little thing.

Agreed 15% sounds like a lot. But, that is what he had to offer me to get me to give up my time and to use my expertise to his financial benefit. Plus, if there is no deal I eat all the expenses and he walks away owing me nothing. How many deals do you see like that? I only take on products that I know will sell, otherwise, why waste my time or my money.

Can you go ahead with the deal to get it closed and than sue? I mean, will the 5% be on paper as a renegotiated commission or is he just going to screw you out when you send him a bill? ? If not renegotiated on paper, go ahead and close the deal @ 5, get a lawyer on commission only and sue for the remaining 10%, than split it. You would at least get 10% when the smoke clears. if 5% is a decent amount, any well-hung lawyer would take it

Wow, that sucks....my condolences.
I think you have your answer by what you said this guy old you.

He's practically begging you to sue him.

I'd ultimately go with what your lawyer says you should do. He's the one who sees your contracts and all....

My best advise to you would be to document absolutely, positively,EVERYTHING this guy says to you from now on. If you do wind up in court, it can only help.
I hope you catch and limit-out on the fattest, biggest fish you go for.

Well, it continues.

Friday-I got a call saying that he is willing to give me 5%. And then said that his attorney said he would take my 5% as payment and take care of me for him and handle everything else too.

Monday-I told him that I would take 7.5% and be happy. He told me that he was insulted that I thought I was worth that, that he was being fair. But, he wants me to void the contract that I have and take whatever he wants to give me.

He even said that if I had put my money into his patent that it would have been done by now. My friggin money?

Shit like this happens all the time.

You have a contract. The client can't weasel out of it now. They are trying to intimidate you because they assume you are in a position of weakness.

Been there, done that.

A buyer started making major demands after the deal had been completely negotiated. The guy I was paying was even trying to get me to accept the deal just because it was in HIS better interest to end the deal as soon as possible. Against advice, I called their bluff and they backed down. I never worked with that clown again, either.

Here's what should happen, your shark will call their shark. Your guy needs to warn the other guy's guy of the ramifications of what will happen if they try any shit.

And be ready to back it up with action if they dig in.

Best of luck.
