They jail journalists in China and Turkey. It's not like it would be impossible to do in the US if the establishment made fake news illegal. Our bill of rights will not defend us from a government bent on destroying free speech. We need congressmen, judges, and a president that will defend it.

Those journalists jailed in China didn't just make up something to collect ad dollars. Even if what they reported turns out to be wrong, it's still not fake news in the sense of what is currently spamming social media.

You are right in that the government is proscribed from interfering with speech. It's a valid question to ask if purposely made up stories based upon nothing and published with the purpose of collecting ad dollars is protected speech. I don't think it is, But not in my pay scale to decide. That said, I'm of the opinion that pizzagate, while a fake story, was written to intimidate and threaten people. A fake story written to harm people is libel. Given that people were menaced because this story was published, this criminal act is a punishable offense should the perpetrator be identified.
