- Ann Mednick petitioned the Department of Public Health and filed a lawsuit requesting that intractable pain be added to the list since it will have fewer side effects than opioids.
- Nirav Shah, the Public Health Director, stated there was not enough high-quality data from clinical trials to support the addition of the condition.
- Judge Raymond Mitchell said Nirav’s thinking was erroneous because medical journals had published reviews of 45 clinical studies that showed the effectiveness of medical marijuana for chronic pain treatment.
- The Health Department refused and appealed the judge’s order.
- The appeal has put the expected expansion of the list of conditions on hold.
- Adding intractable pain to the qualifying conditions would have brought great relief to many patients and increased the sales of licensed dispensaries.
