How does it work? Who is the final authority and what triggers their intervention?
Didn’t the DOJ appeal the decision to allow the Special Master? If they win the appeal, the special master situation would be irrelevant, wouldn’t it?

As I understand it, the final authority is a higher court and could potentially be the Supreme Court, if it goes that far. The appeal process instigated by the DOJ triggers the intervention.

I think it was something about the actually classified documents that the Trump judge told the DoJ they couldn't use to investigate was shot down by the appeals court.

The bit that caught my eye was the implication that Cannon would be taken off the case, if I read that right. How that might work … I don’t know but would like to know if there is guiding precedent etc. I would like to see Cannon experience consequences for her apparently corrupt departure from judicial norms, and (knowing essentially nothing about Federal jurisprudence) can’t game it out.

That’s how I understand it, too but I’m far from an expert.

I think that the DoJ slickly cherry picked parts of the ruling to appeal and not the entire thing. It was somewhat confusing early on, so I may be wrong, but pretty sure it was just to make sure they could plow forward with those particular documents being used still in their criminal investigation and didn't try to overturn the entire thing to give Trump a way to further kick the can down the road by appealing the appeal's decision. My understanding of law is virtually nonexistent though, so... yeah.

What do you think would happen if Dearie resigned?

i think cannon might get removed from the bench, at least temporarily, by a judicial review board. a lot of judges are in trump's pocket, but a lot more aren't, and even the very conservative ones don't want to see someone so blatantly biased making obviously bad decisions, when the court's honesty and reliability is at an all time low, when people's faith in the court has never been lower in the history of the country.
at the very least, they would remove her from this case and reassign it to someone who can at least mask their pro trump sentiments.

More delay that is what Trump ultimately wants.

I don't think that Garland and all the people who are actual specialist that are working on these cases are going to stop. Trump is hoping that he is working with a 2.5 year timeline.

yeah, people keep implying that trump should remain free to cause problems, and i can agree, conditionally. if they're going to let him remain free until just after the presidential elections in 24, then i agree, let him run loose and do as much damage as possible, and guarantee a republican loss, when he splits their voter base.
if they're intending to charge him any time before the actual elections, then just nail his ass to the wall the day after midterms, and get it out of the way. the only real advantage to him staying free is the irreperable harm he is doing to the republican party, and the fact that his magat base will vote for him, fucking over who ever else the republicans might run. if they're not going to take advantage of that, then there is no advantage to trump running free, causing more damage to Democracy and America.

I would rather them just be as thorough as possible since there is always that possibility that 1 of the 12 jurors is a cultist. At least this way everything that they get can be exposed in a court of law.

Trump is the symptom, not the cause of the divisive propaganda. My pipe dream is that they are working to dismantle the entire enterprise of lies that the right wing is using to maintain power.
