I have no problem saying it as I see it. Your friend participated in something that caused a death. If he did not participate, the race would not of happened, and the death would not of happened. To be honest, I could care less if your friend would of been stone sober. Everyone is at fault and all drivers should be responsible in some part for the death. The surviving passenger can also be partly responsible if there was no attempt to stop the event (turn off the key, pull into neutral).
Sorry...They all fucked up and everyone needs to be responsible for their actions. Be damn lucky no one else got hit or killed due to that race.
that is speculation to say that kid wouldnt have raced someone else. maybe the kid that killed his girl was the reckless one and egged on the other guy who was more causious.

I don't see your points at all on this. This guy participated in an illegal activity. Had he NOT participated, there would have been no race... and the girl would not have died. How can you ignore that fact?

Nascar isnt illegal,neither is manufacturering a car or selling a car,drag racing is illegal to even participate in,& the excuse gave about being egged on,isnt that peer pressure?,thats a hell of a defense,it wasnt my fault i was racing your honor,they egged me on & kept teasing me:dunce:.

Your friend will more than likely be going to jail...It is a hell of way to learn that you are responsible for your actions, but, none the less he is going to be serving some time.

In 83 I lost my fiance the exact same way... some ass gave her a ride home and crashed into a bridge after racing..

i smashed my car once with i was 17 we was drunk and stoned on my L's and my mates and i whent driving like we normaly did and we was racing and a purple xr8 ute came out of a side street and thort he could beat us and stop half way over the stop line, it was either t-bone the ute or hid the ditch, well i whent with the ditch and we slid across a few islands and the back of the car wiped out a road sign, lol wats funny tho i had one mate in with me ( ex-house mate wanker punched a hole in a wall so i kicked him out ) he got hit in the head by the rear view vision mirra, i told my mates to go cos i was in shit anyway so yea, lost my l's for 12 mouths 1200$ fine

The only thing we can say is that both drivers were responsible for racing while intoxicated, and thus (at least partly) responsible for the girl's death. Other than that you all have nothing more to go on than your own fantasies and edumacated guesses.
As far as how it will turn out in court..that depends on what the police can prove and what course of action the boy and his attorney decide to take. If he is a man he will stand up and take responsibility for being such a fucking idiot.

This is similiar to a bullshit case that happened in my town. The bullshit part is the charge that the kid racing got...

Two drunk dickheads were racing and one hit a 15 year old kid who was riding his bike home. Both cars took off and left the kid to die in a ditch. The next day the one who was racing(the car that didn't hit the kid) turned himseld in once he saw the story in the paper of the kid getting hit. The kid that hit him, got his lawyer then turned himself in. Swore up and down he thoguht he hit a deer, wasn't drunk etc..The fucking scumbag got 5 years....thats it, for killing a 15 year old...

The other kid who was racing but didn't hit him, got in some trouble but nothing near what the kid who got 5 years got...

This was a complete bullshit charge, That dude should have got ten minimum. He was a repeat offender! His mommy and daddy had money and got him a great lawyer.

I'm sorry but he has what's coming to him. He should have exercised better judgement, and focused on getting himself and his passenger home safely. He was responsible for this person, and they paid the ultimate price.

well I doubt he was over the limit, he is a big guy and he just had a couple of drinks with dinner...but yes he was probably still intoxicated
They may just be adding the intoxication charge to round out the view on him. They know that it could be almost impossible to prove his intoxication. What they've really got a hair across their asses about is the racing, and he entered into the race in full knowledge of its dangers and legality. He shares full responsibility here.
a good lawyer will get his charge reduced or dismissed..the other guy who wrecked the car might be screwed...and how can the court prove he was drunk??? was there documentation by the police?
Witness statements would help, and may likely suffice to prove that he was drinking, what they'd also need is (likely multiple) witness statements that he was clearly intoxicated. The issue is that, according to the law, he shares responsibility for the accident here. And, in my honest opinion, not just legally, but ethically and morally as well.
Most states have laws that say if you commit a crime (racing in this case)... and someone dies in the process (the date in this case), you're gonna face murder/manslaughter charges.

I believe that is incorrect, based on the fact that they sat on this for a year (means they're getting counsel on how to proceed with it), and that they were RACING. Cali has some tough new racing laws because there have been enough deaths to make it an issue.

Of course not, it's an organized race with trained professionals in specially designed vehicles on a private track who are wearing all the safety gear in existence PLUS they have ambulance, fire and paramedic on hand. This is opposed to an impromptu race being held by a couple of drunk kids out on a date and having been served enough drinks (underage, as well, apparently) fucking around on the public roads. Seriously, it can't be that difficult to make the distinctions here, can it? :?

Hardly! Her assertions, and the assertions of people who have an actual grasp of the law are not purely emotional, and they're not trying to make this thing 'fit their emotional needs'. Wow. I think panhead said it all best.

Ok heres the story...almost a year ago my friend was out with his friend and his friend's date...they went to dinner and got drunk. Anyway, on the drive home, the one dude tries to race my friend on an open staightaway, loses control and flips his car. My friend saw and turned around. when he got back to the scene the guy was fine, but his date was already a goner. They called the police, but my friend figured there was no reason for him to stick around and get a dui. So like I said, all of this happened almost a year ago...but the other day the cops came and arrested my friend for vehicular manslaughter with gross negligence, and fleeing the scene of an accident with a death involved. So like the title says, how screwed do you think he is? I think he is gonna have to serve some time, but I think if he gets a good lawyer it may onle be a year or two. Any opinions? ANyone know of something similar like this, and what the outcome was? :peace:

Drink...drive...dickhead...he's screwed I hope. I have no sympathy for drink drivers or street racers. I feel sorry for the other guys girlfriend's family though.

I have no pity for your friend... I lost a friend last year due to an intoxicated driver, nothing can ever bring her back or change the fact that someone drove drunk and ended her life. I hope the two guys spend the rest of their lives in prison for their unnecessary actions causing a fatality of another young innocent women.
