No, I won't be doing any time... My lawyer keeps telling me that something is going to happen and they will hit me with a misdemeanor, but shit, the fire happened 2 1/2 months ago and I still haven't heard anything. No warrant, no nothing. The night of question I just played stupid when they asked about the plants...

"What plants officer?"

"The plants we found in your closet."

"I honestly don't know what you're talking about."

"You don't know what I'm talking about?"

"No sir, I sure don't"

"Look, you help us, we'll help you. We're looking for the bigger operations. We just wanna know where you got the 12 identical marijuana plants in your closet."

(Not knowing that I grew them bitches from seeds and cloned them like I have been for years.)

"MARIJUANA PLANTS?!?!?! Officer, if you're going to make such outlandish accusations I'm going to have to refrain from responding without a lawyer present."

"You're only making this harder on yourself; you do realize that. We're going to take those plants with us and it's going to come out to be about four ounces."

(Yeah right!)

"I don't know what you're talking about officer, honest to God. Am I free to go now?"

"Get back in the car! You're being detained."

5 minutes later they let me out and I haven't heard anything since... except from my lawyer who keeps telling me that they will most likely hit me with a warrant once they assess the weight and get the results back from the lab. Problem is, it's been 2 1/2 months and still the same story from my lawyer. I don't know what to think. I'm praying to God that since my plants were in veg and no budding at all that they'll never press charges and statute of limitations will kick in and I'll never see any repercussions. I know that's some serious wishful thinking, but you never know. Everyone, keep your fingers crossed for me. :)

Possession of 4 ounces or more of marijuana is a felony punishable by up to five years in prison and a fine of up to $50,000. Possession of less than 25 plants is protected under the Alaska Constitution’s right to privacy (See Ravin v. Alaska). Possession of 25 or more marijuana plants is “Misconduct involving a controlled substance in the fourth degree” and is punishable by a fine of up to $50,000 or five years in prison. Decriminalization: The state has decriminalized marijuana to some degree. Typically, decriminalization means no prison time or criminal record for first-time possession of a small amount for personal consumption. The conduct is treated like a minor traffic violation.

Medical marijuana: This state has medical marijuana laws enacted. Modern research suggests that cannabis is a valuable aid in the treatment of a wide range of clinical applications. These include pain relief, nausea, spasticity, glaucoma, and movement disorders. Marijuana is also a powerful appetite stimulant and emerging research suggests that marijuana's medicinal properties may protect the body against some types of malignant tumors, and are neuroprotective. So, the warrant got issued for my arrest the other day. Lawyer contacted me and said they got me for 5.9 ounces. I know for a fact that this is a heavily inflated number. Lawyer said it's not uncommon for them to lie. Figure they would rather have me plea down from a felony to a misdemeanor, than a misdemeanor to an expunction. Still bullshit in my opinion. Lawyer said we might have a case though. Apparently, here it Texas it's different than I've always thought. I've always had this preconceived notion that if you got caught growing, it would be how many plants you had that would determine how much trouble you were in. To my surprise, that is incorrect. They chopped down everything, let it dry and weighed it (3 months after fire). Now, I don't know how they got me for 5.9 ounces of, as the law specifically says, "a usable quantity of marijuana." All of my plants they chopped down were in veg. For all the DEA knows, they were male marijuana plants with no "Usable" amount of marijuana on them. Anyway, just thought I would give a heads up to my situation. I did my walkthrough with my lawyer and got my fingerprints and mugshot taken. A wonderful day indeed knowing that I am now in forever in the system.
