I got Arrested Tuesday night.
I was sitting in my house, minding my own buisiness, when see a couple cops next door. I knew immediately they were meant to be at my house, so I take everything incriminating and put it away. About 10 minutes later they are at my house. I see the light shine on my window, so I ask who it is, and then I try to be slick and slip out the door. I get outside and ask what they want. they tell me they are here for the marijuana. It ended up being the task force. They asked me if I had anyone else in the house. I told them yes, I had company. So they bang on the door. I tell my friend to close the door behind her. I keep tellin her to close the door. She's just standing there lookin like a deer in the headlights and and finally she walks out leaving the door wide open. At this point I was pretty sure I was fucked.
I tell the cops very clearly "You do NOT have consent to enter my house. I do not consent to any searches." Well after sitting there arguing with me for about 5 minutes he enters my house anyways. He claims he saw a bong (He also claimed he had probable cause because he smelled weed but I knew better then that.) He goes through my entire house, and comes back out empty handed. He kept trying to get me to consent, but he finally realized I wasn't going to give it to him so they put me in the cop car. I sat there for 2 hours, till they finally got a warrant.
They searched my house and came back out. They seized 3 glass bowls, (One of which wasn't new, but I cleaned it with rubbing alcohol, and it hadn't been used in months, so I don't think there would of been any residue in or on it, I'm hoping that will help in court.) They found 2 waterpipes. one was acrylic, but on the paperwork they gave back to me it said 2 glass bongs. (I'm thinking with all the bureaucracy in the government this could work in my favor.) and a grinder.
I was charged with misd. posession, misd. paraphernalia, and felony public nuisance. I spent 2 days in jail, before I got bonded out.
I just got out last night, and have a shitstorm of work ahead of me. Not to mention the job interview I missed yesterday. Anyone here have a similar experience? Think I have a leg to stand on? I was appointed a public defender, but they didn't tell me who it was so I don't know how to contact them until I get to Pre-trial.
