Not to argue, but I've been asking for some time, for information on people who are actually serving prison sentences for a first offense of marijuana possession with no aggravating factors. I don't get the impression that it's very common.

Usually a first time felon in AZ has an opportunity to participate in a Diversion Program to minimize the felony or diss it all together after completing a few court orders (for marijuana - drug eduction & fines - no restitution - fines are unwarrantable if not paid and the court will send them to collections and FUCK your credit up, kind of odd mates)

Sounds like Horne & Montgomery want NO dispensaries... I have read nothing about abolishing the Medical Marihuana Act itself!!

So shutting down dispensaries may not be such a bad idea!!! By no means will the duo be able to shut down the Arizona Medical Marihuana Act of 2010 but they could shut down the Medical Marihuana Program ran by the AzDHS...

Montgomery has publicly stated he does not want to uphold the patient portion of the law he also has requested dhs to stop issuing cards which is stupid in itself if you have actually read the law. Montgomery has come out and said he wants to prosecute minor possession and growing without regard to the amma. The state does have a legal recourse to prevent dispensaries from ever opening. Here is how it would work. Once a prospective dispensary owner is granted a certificate, they have one year from the date of issue to open for operation. Before a prospective dispensary opens, they must be approved by their local zoning authority. Once they have been approved by their local zoning authority, then dhs must inspect heir facility and only once all requirements to operate have been met will the dispensary be granted official state approval to operate. It is this last act which is the legal point which the state clearly opposes the controlled substances act. So there are two main ways the stage will hold this up. Their first offense will be the local zoning authorities. This is most effective for county land and some municipalities. This method has been tested in sun city and brought to court by the dispensary owner and the judge ruled against him, upholding the counties denial of zoning approval. This case sets a legal precedent saying that local zoning authorities may deny dispensary approval. Now that should take care of a number of dispensaries. Now some municipalities or areas may want dispensaries for financial gain or the like. The states second recourse would be to never approve facilities to pass; final inspection or delay the process long enough to stonewall the prospective dispensary so their certificate expires. Oh and there is another little catch, if you are granted a dispensary certificate, and you fail to open in the allotted time, you are barred from applying for another certificate. So what's to stop the state from maintaining this game where they keep granting certificates at 5k a pop and never let you actually open then they say sorry you didn't open the first time so we can't give you a second try. This is a way for the state to make money off the amma but still never hav marijuana. We are all getting royally fucked by the state and I think that the prospective dispensary owners are getting it the worst by far.

I hope the MPP and the jerkoffs responsible for the 25 mile bullshit have learned a lesson here. A system with taxes and regulation isn't going to work. Especially in states like AZ, who are filled to the rim with fundamentalist nutbags who will use any means necessary to get their way. If Prop 203 had just decriminalized possession and cultivation for people with a doctors rec, the state couldn't do anything. Right now, I wouldn't be surprised if they get away with shit canning the whole thing.

This would take a organized well run campaign and the soonest we could see this on the ballot is in a little over 2 years in 2014 during the interim election. The second way it could be shit canned is if there is a 2/3 majority vote on state legislation repealing the act in both the state house of representatives and the state Senate. Then the governor would have to sign it into law. The second method is less likely because it would force politicians to actually stand up for their beliefs and vote on integrity rather than political expedience and we all know how that one plays out.

The People have misunderstood the role that the federal law plays in the state system. The California courts long ago recognized that state courts do not enforce the federal criminal statutes. The State tribunals have no power to punish crimes against the laws of the United States, as such. The same act may, in some instances, be an offense against the laws of both, and it is only as an offense against the State laws that it can be punished by the State, in any event.

Dispensaries are not limited to how many plants they may cultivate where patients may cultivate 12 plants!! Since the dispensaries in Arizona will have an impact on the interstate commerce i believe they will never get a chance to open or operate!! Get your 4k back and the AzDHS keeps the other 1k! Pull out now! I see no future for dispensaries in Arizona! Many will agree and many will disagree. Medical Marijuana is here to stay, with or without dispensaries!

Is the Sun City case you are referring to the White Mountain Health Center case? That case has yet to be resolved although what happens in that case is going to set the precedent going forward. That is the case that Billy Boy is hanging is hat on.
