It's already affecting me. It is making me unspeakably angry. I cannot find the words to express my anger and despair over this, together with trying and failing for almost four years to find a job that will allow me to move to Colorado. Colorado was competitive before. Now I want to just give up.

I'm moving to Wa.;-) @ the end of 2013.
I renewed my card early. So, i'm good.

If for some unforeseen reason I have to stay into 2014. I would be fooked in the cultivation dept.

That 25 mile rule really sucks.

If the 25 mile, as the crow flies, rule stands...you could have a situation where the dispensary is w/o 25 air miles, but be [practically] inaccessible. ...say a disp opens on the south rim of the Grand Canyon...the people on the north rim would have to travel by air or drive 300miles to get to the "local" dispensary. That's an extreme case. For me, I could have to drive as much as 60miles.

.....any word on the rescheduling hearings?

This is a good point, this is another good comment that should be brought to AZDHS attention.
I would vote 3x on this comment to ensure the department looks it over.

The department has also put in place accountants to ensure that non-profits are not over paying for medicine from other outfits.
Is there any quality control involved in the measure? How/Who is determining the market price and quality? I assume in the overall value quality has to play some roll. Unless AZDHS thinks a pound is simply a pound and should cost the same regardless, there is huge informational/knowledge gap regarding mmj in general in the department and we expect them to be able to determine fair value etc.?

$5 mil in the fund, some of that money should be going towards patient interests, technically we made that reserve.

I don't want the state determining the price of medicine that is insane and foolish. The market should always determine the price the real change should be an exception to or a full repeal of the 25 mile rule. I have had the new law in MA and they have something called a hardship voucher for patients who have difficulty affording medicine, accessing it or being able to physically go to the care centers. I have a feeling that such a clause was injected into their law to account for the violation of equal protection which is inherent in a law excluding rights for some and not others. I don't give a fuck what the assholes in charge or this state say or what the half ignorant steeple who buy into their bullshit agree with. The law is the law and not popular opinion for a reason and that is to provide protection and advocacy for those who are not in the popular majority.

The agency will be sub contracted by the AzDHS to ensure "fair market" value is being given... Many lose sense of reality and forget the firm will be working for the AzDHS - another conflict of interest. This doesn't favor the patient, it simply ensures sales are happening if not that dispensary will lose their license next time around.. What a crock!

Dispensaries have to show NO profit. They are non-profits.

license is good for 1 year... Random inspections can take place (at theAzDHS discretion). Yes a licensee can lose their license and another licensee can go right into the same place and operate... Come on now... The property owner does have to sign some liabilty waivers and what not but if property is owned by licensee then it is their decision to allow another licensee to operate in that building.. So it comes down to who's name is on the building (deed) or who has permission from the owner of the building to operate.! Simply stuff.!

Non profits and Not for profit... The State and IRS classify differently.. Though a corporation maybe a "non profit" or "not for profit" under State laws that does not make them a "non profit" under federal tax laws.. Show me the paper work from the IRS that includes the EIN# and I will tell you what the corporation is classified as just by how they will be required to file their taxes annually! (Will say how to file - 1065,1040, so on...) Organizations that are exempt from federal corporate income taxes (501(c)(3)s and the other "501s" of various sorts) do not pay federal taxes on net income (the surplus of revenues over expenses). That is the original meaning of "exempt organization" in the federal tax code.

Fair market value and whether or not the dispensary claims a profit are two completely separate issues.

Or the opposite end of the extreme, the growers are super talented, have proven genetics to work with, experience with those genetics and can produce quality and quantity consistently. But it does not stop there, owners need to have a compassionate outlook as well, the dank with ultimately bring the patients in the metro CHAA's, not to mention build a fast growing reputation. Other outfits will have to reassess their product, maybe even their employees, if they want to compete or be considered as an establishment with top-shelf meds. If there is not already, hopefully there will be an outfit attempting to set this standard for patients and non-profits in the near future.

I met someone "guaranteed" to get one of the supposed six growing positions at a tucson area cultivation facility solely because he knows the cert winner. This individual has harvested, mediocre herb at best, one successful time in their life.
They did not know to vent the hot air away from the grow to help combat high temps.
This example makes me worried about the initial quality of meds.

Lets not even go into what it costs to produce 1 oz of medical herb...No where near $200 an oz... What you are not seeing is the costs of running a Non or Not for profit.. (Folks need to eat - Livable Wage) Most non or not for profits pay their Board members a livable wage... Remember the different between a wage and an income for tax purposes! That is where the difference is.I am SUPER worried about the company that will determine what patients will pay for this "fair market" medicine! Just like the NMD board in Az (corrupt); another flop by the hands of Our governor Brewer. What an impact this "fair Market" value system will have on the amount of taxes collected in the future will be determined by how patients decide to defend their access to medicine (if it cost more you pay more taxes). ei. (1oz) $200 x .10 (tax-sample) = $20 in taxes... A $200 oz will cost you $220 when its all done. This is just a sample.. The current sales tax is close to 10%.. Will there be a separate tax for marijuana in the future? Will there be a tax on top of the sales tax? Remember the sale of cannabis is legal through a dispensary so this is a great means for the State to cash in on taxes. This is great until the State government gets greedy...

So.. Will the opening of this first dispensary effect those within the 25 mile radius shown in the first post?? If someone lives within that radius will their right to grow be effected now? Sorry if this has been covered, i'm not clear on this. Thanks
