To be considered an enemy combatant you need to be in the military, to be considered a civilian combatant you need to be actually engaged in armed conflict. Drones were employed specifically as the "smart" way to conduct "war" - eliminating collateral damage, mainly innocent civilian casualties. For the most part this seems to not be the case.
