Medical Marijuana Dispensary Application Process to Proceed

Last May (after receiving a threatening letter from the Arizona U.S Attorney’s Office) the Governor suspended the dispensary portion of the Arizona Medical Marijuana Act with a genuine concern that state employees would be federally prosecuted. Last year, we asked the federal court to provide us with guidance regarding the obvious conflicts between the Arizona law and the federal Controlled Substances Act. The federal court’s refusal to address the issue on the merits left many unanswered questions regarding these conflicts. It’s unfortunate that the Federal court and the Arizona U.S Attorney’s Office couldn’t provide clarity for us on this issue. However, after careful consideration, the Governor has asked us to implement the dispensary portion of the AZ Medical Marijuana Act.
Our first step will be to review the rules for accepting dispensary applications. Our rules had originally stated that we’d accept dispensary applications last June. Obviously, that’s no longer possible- so we’ll need to set new application dates using the State’s rulemaking process. We’re working on those rules right now. The process is complicated by the fact that a lawsuit called Compassion v. Arizona is challenging the scope and constitutionality of our medical marijuana rules. If that lawsuit is withdrawn or settled quickly, we could begin accepting dispensary applications this Summer.

I'm thinking it would be possible to rent a cheap house in the middle of nowhere and use that for an address, and still grow at your main residence.
 
luckily, there won't be a dispensary anywhere close to me haha! i do feel bad for any of the farmers that will be close to any once they start opening though...

Yeah I'm pretty deep in West Valley Suburbia even if they open one in Goodyear my community is so far back I think I might be ok. I know I was reading where they wanted to open in one up in Goodyear so I'm sure that application is part of that list of " on hold applications" bummer for patients that have to pay those stupid asinine prices.

I thought you were in the west valley ? If a dispensary opens in PHX you will be within 25 miles
wont you ? Just curious before I come live nearby !
 
How about the Arizona Constitutions equal privileges & immunities clause which mandates:
" No law shall be enacted granting priviledges or immunities which, upon the same terms, shall not equally belong to all citizens or corporations." Arizona Constitution Article 2 & 13

I believe this may be the answer.
 
Everyone will have some time I doubt the first dispensaries open their doors around mid summer say june-july

Hopefully late summer when I renew my MMJ card I will still be able to get grow rights for at least another year or until the law is equal for all.

He is deeeep in tucson. haha, I dont think he will have to worry. His house is a journey to get to lmao!
 
Oh he's over 25 miles from tucson or other small towns. 25 is a lot of miles ...Id bet he won't be far enough away either.

My in-laws live in Goodyear, wonder how they'd feel about me moving in, lol!
 
Problem with Goodyear is it is within 25 miles of Phx . . . I really think we have nothing to worry about in the long run & little to worry about if you stay off the radar.

Is enough reason to repeal the "25 mile rule"


It seems alot of folks are happy for dispensaries RAPING them with no lube!


I do NOT know about you but I plan to invoke my constitution rights and Uphold the Governor to manifest a fair and equal Program with the peoples interest into account.

Aren't we all on the radar? I mean they have my address and know I have been approved for cultivation...
Problem with Goodyear is it is within 25 miles of Phx . . . I really think we have nothing to worry about in the long run & little to worry about if you stay off the radar.
