From what I am to understand of Michigan, you would need to each have your plants in separate locked rooms. I guess I am a little confused as to why you do not just make one person in your household, either you or your wife, the primary caregiver? If just one person had everything registered to them, there would be a lot less hoops to jump through. I'm sure someone from Michigan could shed much more light but I think that is right . . .

I don't see in the law where you can't pool your plants (husband and wife being different legally than buddy and homie) in the same locked room. Extra safe would probably be to go with the guy above and name one of you caregiver but I really don't see what letter of the law it'd violate not to. looking at each individual and the law, you are growing in a locked and secure room, and she is growing in a locked and secure room. fact that it's the same locked room shouldn't matter, you're both owners of the home and residents of said property, correct? Some people go overboard and label each plant and cutting with names but I do not. To me, if the owners of the property can provide cards enough for the number of plants found present by the cops and the weight on hand then its lawful. I don't see how it isn't and that's their burden to prove you're doing something outside of the law.

As far as I understood for a married couple its ok but for friends and such its not, that's what a lawyer told me couple of years ago, don't know if its different now

I believe the issue many are avoiding by not allowing over 99 plants under one roof are federal sentencing guidelines, as it can land you 40 years :o

We are married, live at the same property and do lable ea. plant just in one room.thanks for the responses
new mmj laws after 4/1/13 and before really frown on collective use of rooms for multiple caregivers. have yet to see a court rule in favor of a caregiver in this instance because in the courts eyes, its creating a criminal enterprise, plus, if you have full patient lists and go over 99 plants, thats mandatory minimums from the feds if you get caught...and oakland/macomb counties are HOT HOT HOT right now. i wouldnt do it.

The key point in Bylsma was access to other's plants.

Dr. Bob
which is the issue everytime with multiple growers in the same house. tell me, whens the last time you locked a door inside your house from your wife/husband that mutually owns the house? never in most cases, this is why its never a good idea to gamble when it comes to potential jail time or even potential court proceedings.
