closing arguments started this morning, .....

OAKLAND, Calif. (AP) - Oakland police are preparing for possible violent protests after jurors reach a verdict in the trial of a former Bay Area Rapid Transit police officer accused of fatally shooting an unarmed black man on a station platform.

Police on Friday simulated a riot at the Port of Oakland in which plainclothes officers posed as protesters and threw objects at other officers.

Oakland police spokeswoman Holly Joshi says the shooting of 22-year-old Oscar Grant on New Year's Day 2009 has raised tension in the city. Johannes Mehserle, the officer accused of killing Grant, is white. He has pleaded not guilty to murder.

Police want to prevent the type of violence that rocked Oakland days after the shooting, when rioters smashed storefronts and set cars on fire.

(07-01) 04:00 PDT Los Angeles - --
Jurors in the trial of former BART police Officer Johannes Mehserle will be given the option of convicting him of second-degree murder, voluntary manslaughter, involuntary manslaughter or nothing at all, a judge ruled Wednesday on the eve of closing arguments.
Legal experts called the ruling a victory for the prosecution. The defense had sought to rule out the manslaughter counts, but Judge Robert Perry said jurors - who are scheduled to hear closing arguments today - had enough evidence to consider them in connection with the shooting of unarmed train rider Oscar Grant.
"The defense wanted all or nothing, betting that the jury would not find him guilty of murder," said Laurie Levenson, a former federal prosecutor who teaches at Loyola Law School in Los Angeles. "This gives the jury a compromise position."
Perry also took first-degree murder off the table, against the wishes of, ........

OAKLAND - Oakland is a city on high alert. Police are now working 12 hour shifts after finishing up, what was described as, crowd control training. The Port of Oakland has been turned into a staging area for mass deployments. And, in recent days the city has spent countless hours removing dozens of graffiti messages; including one that read: "LA better get it right or else."

"We are expecting god to do a miracle in this city," Oakland church leaders are trying the head off the unrest with prayer. A large crowd gathered in front of City Hall Monday night. "We believe god will intervene and cause us to have peace with the verdict, with the Oscar Grant case. God's going to bless our city not to burn," says Bishop Bob Jackson of Actsfull Gospel Church.

But the rest of Oakland is bracing for the worst. The sounds of saws, power screwdrivers and hammers can be heard up and down International Boulevard. For 30 blocks merchants are boarding up store fronts; from Fruitvale where the crime happened; to the City Center, the site of previous violence. "Do you think this is going to stop anyone?" FOX 40's John Lobertini asked. But Sam Qutob couldn't hide his true feelings, "No, no, it's not gonna stop them. They're gonna burn it, god knows what will happen," he says.

Jurors have three choices: second degree murder, manslaughter or involuntary manslaughter; the judge took away murder as an option. For young blacks in Oakland, a guilty verdict is the only justice. "I believe he was a racist, and he was sneaky about the way he killed Oscar Grant," says 20 year old Bartholomew Mustafa. 24 year old Monique Holloway wasn't any more understanding, "Guilty! Point blank: he's guilty!" Bernard Williams, however, took a more philosophical tone, "Only god knows what the real sentence should be." ..........

http://www.californiabeat.org/2010/07/06/mehserle-jury-deliberations-delayed-due-to-illness

(7/6) — 9:40 PDT — LOS ANGELES – The jury weighing second-degree murder charges against Johannes Mehserle, the former BART police officer who fatally shot Oscar Grant, will delay its first full day of deliberations because one juror is ill.
The jury will resume its deliberations tomorrow, July 7, according to the Los Angeles Superior Court.
It received the case last Friday after receiving jury instructions from the judge and listening to the end of closing arguments.
One of the five men on the panel will no longer be able to deliberate after tomorrow; if the jury does not reach a decision an alternate juror will be selected and deliberations will start over.
Three of six alternate jurors are left.
Judge Robert Perry has ruled the jurors can consider second-degree murder charges, voluntary or involuntary manslaughter or outright acquittal.
Oakland community and city leaders are calling for peace when the verdict is announced. Many fear violence could erupt should Mehserle not be convicted of murder.

this case is shady from what ive read about it. he claims that he thought he pulled his taser. his taser is on the opposite side as the gun (at least on the cops where i live) they already had him down on the ground with several officers there. and if the guy did have a gun and got tased, the shock could have cause him to pull the trigger. cops misuse tasers so often they should not be allowed to carry them. they dont use common sense anymore or other options they just tase first. it should be a completely defensive weapon not something they can just threaten and use on people all the time. that cop should be shot.

the cop had his tazer out at one point. he put it away in exchange for his firearm. you can see him tugging to unsnap it from his holster as he pulls it. his tazer was already out so he would not have had to unsnap it. racila slurs were shouted out BY the cops. he takes a 2 handed shooting stance and fires. he says he "thought he(the victim) had a gun".

it went to the jury last friday.

monday was a holiday. no deliberations.

tuesday a juror called in sick. no deliberations.

today a juror had a DR appointment. no deliberations.

tomorrow is the last day before one of the jurors has to leave on vacation. an alternate will be added and deliberations will have to restart. sounds as if tomorrow may be a cancel because of this.

friday appears to be wide open, as of yet. maybe they can get to it then.

80 Oakland police officers are set to be laid-off this weekend, due to budget restraints.

i'll post more as it happens. :)

That's gonna work out well, I bet. There's no need for police in Oakland.
because they have to lay these 80 off they will be below the required number to continue to receive special additional funding. this is going to cause even more people to be laid-off. it's gonna be an ugly downward spiral.
