Lazy neighbor won't let me use vine killer on their crawling vine than eventually gets into my back yard

The power company was out and they just cut down a few very small trees that were working there way up to the power lines. They didn't care about the vines at all.
They don't want the vine killer on his property bc he has a dog in his back yard and his 6 month old baby is outside. The vine is like a vine bush and its on his fence 30 feet behind his house. The vine killer isn't that toxic, but I understand his concern bc I have a 9 year old niece. I'm telling him that it needs to be cut down soon. If he doens't cut it down soon I'm telling him the neighbor behind him house vine is on his property to said I could spray the vine killer. I think that is fair right guys??????. Like is lazyness isn't causing me work, etc. The vines were takking over a tree in my back yard and sucking the life out of it....

Sounds tough, man, sorry for the frustrations. Reading through this thread, I’ll offer a Saturday morning, stoned on the couch take. Not trying to be a jerk, just offering a different perspective. Regarding the vine, I’m no expert on whatever that is, but the amount of dead stuff in the lines suggests a neighborhood problem likely not limited to the plant growing in one dude’s lawn. Now, as someone struggling with a neighbor I consider unreasonable, and as a parent of former-children and owner of pets, I’d not take kindly to someone telling me I should just keep my pets and kids out of my own backyard for a few days. Non-starter and not a chance. Especially if I believed the problem were much more widespread than my back yard. I would be happy to work with you to attack this vines with non-toxic measures, including some labor. Roundup is evil shit and should be outlawed, imo, but that’s a different discussion. Good luck though. Sorry for the hassle. And the sore back/neck, which I know is frustrating and painful.

Be aware of treble damages for willful violation, as well as associated cleanup costs.
MA state law Part III, Title III, Section 7.
A person who without license willfully cuts down, carries away, girdles or otherwise destroys trees, timber, wood or underwood on the land of another shall be liable to the owner in tort for three times the amount of the damages assessed therefor; but if it is found that the defendant had good reason to believe that the land on which the trespass was committed was his own or that he was otherwise lawfully authorized to do the acts complained of, he shall be liable for single damages only.

Yeah I agree, but if he don't want me to use weed killer he needs to cut it down asap.
