We can always put another initiative on the ballot if we want dispensaries.
This is very true but the fact of the matter is that right now P2Psales are not allowed. If you do not grow your own then the only one that can legally get you your meds for compensation is your ASSIGNED caregiver.

With possession still being legal for patients and caregivers, it will be hard to prove any sale has taken place...unless you sell to a cop or snitch....or do it on camera. It's only illegal if you get caught.

If we're not willing to get another initiative on the ballot, then we need to move on and make the best of what we have...help patients that can't grow find caregivers...trade meds to give patients more variety...keep everything low key!

So no P2P...anyone want to talk about Section4 (j) A registry identification card, or its equivalent, that is issued under the laws of another state, district, territory, commonwealth, or insular possession of the United States that allows the medical use of marihuana by a visiting qualifying patient, or to allow a person to assist with a visiting qualifying patient's medical use of marihuana, shall have the same force and effect as a registry identification card issued by the department.

People will be opening their homes to Washington patients eagerly lol.....they allow 15plants 24oz.'s or a 60 day supply. Now how would they handle that? This is called a reciprocity agreement...I guess they'd just say they look to "our department"

either way...what are they suppose to do? Or is this part of the law now been effectively omitted? Sign up with a cg and wait 21 plus days?

Is Caregiver to "Any patient" section 4e legal?

How bout caregiver to caregiver?

Im thinkin those three judges smoked too much weed back in law school, they didn't think that out too well. I hope the Supreme court slaps em silly.

instead of pipe dreaming-

let's follow cephalopod.

Sec. 4. (a) A qualifying patient who has been issued and possesses a registry identification card shall not be subject to arrest, prosecution, or penalty in any manner, or denied any right or privilege, including but not limited to civil penalty or disciplinary action by a business or occupational or professional licensing board or bureau, for the medical use of marihuana in accordance with this act, provided that the qualifying patient possesses an amount of marihuana that does not exceed 2.5 ounces of usable marihuana, and, if the qualifying patient has not specified that a primary caregiver will be allowed under state law to cultivate marihuana for the qualifying patient, 12 marihuana plants kept in an enclosed, locked facility. Any incidental amount of seeds, stalks, and unusable roots shall also be allowed under state law and shall not be included in this amount.
that part of the law alone should disqualify the opinion. judges are just allowed to rule whatever they want now? even when in DIRECT opposition to the text.
(b) A primary caregiver who has been issued and possesses a registry identification card shall not be subject to arrest, prosecution, or penalty in any manner, or denied any right or privilege, including but not limited to civil penalty or disciplinary action by a business or occupational or professional licensing board or bureau, for assisting a qualifying patient to whom he or she is connected through the department's registration process with the medical use of marihuana in accordance with this act, provided that the primary caregiver possesses an amount of marihuana that does not exceed:
(1) 2.5 ounces of usable marihuana for each qualifying patient to whom he or she is connected through the department's registration process; and
(2) for each registered qualifying patient who has specified that the primary caregiver will be allowed under state law to cultivate marihuana for the qualifying patient, 12 marihuana plants kept in an enclosed, locked facility; and
this portion of the law absolutely allows for caregiver to have the same rights and protections as patients. also the reciprocity clause. what weight do other laws carry in these arenas?

(e) A registered primary caregiver may receive compensation for costs associated with assisting a registered qualifying patient in the medical use of marihuana. Any such compensation shall not constitute the sale of controlled substances.
the bomb. as long as the disp owner and employees are registered caregiver's, ANY registered patient may obtain meds, through donation for recompense, from ANY registered caregiver.

IT'S NOT A SALE.

simply, how could the judges not see it that way. the leaves no room for interpretation.

i think i know how. they got their strings pulled. all this right before harvest. thousands have been made into criminals now, simply for conspiring to liquidate their harvests that aren't even here yet. let alone the actual sale.

BIG FUCKIN MONEY. so for the money these judges have SOLD OUT! for political aspirations these judges have SOLD OUT. their constituents, there neighbors. their STATE, and their COUNTRY AND CONSTITUTION.

they do this all the time. to all sorts of people, for all sorts of reasons. many of you have never been to a court for more than a traffic ticket, and are now just scraping the surface of what these schmo's are up too.

there is alot to be done here if we want to be taken seriously, and expect results.
the first, in my opinion will be to bring these judges under review, a show of no confidence if you will. with their poor decision in this matter(direct conflict with the text of the law), their voting hiistory must now be scrutinized.

more than likely i'd bet iit sucks, call for their resignation, on the grounds of treason.
direct opposition to the will of the people, resulting in their harm=TREASON.

POW, bitches. right to the kisser.

the next will be to aggressively pursue Schuette, (hearby referred to as, Shitty, The Big Shit, or Shit For Brains), for his direct molestation of our medical marihuana law. this guy is bad news, and he needs to go. it owuld appear his main directive at this point is to turn tens of thousands of medical marijuana patients(the law also allows for UNREGISTERED PATIENTS also) into felons.

keeping in mind he is the top police officer in the state, he could only have one motive for doing this, although many faceted. keep the jails full, get the money for the police cars, radio's, hours, secretaries, vacation days, flir camera's, heli fuel, attornies, etc.
he's trying to keep the giant money machine running. it is our DUTY to stop this.

that brings up the interesting topic of duty. we should discuss that also.

we are gonna have to stop thinking like comfortable folks, and start ACTING like the pissed AMERICANS we ARE. we are gonna need to be shot callers again. remember how we used to run shit. a DOMINATING force. make big moves.

there an estimated 600,000 cannabis users in michigan. recently i had seen the figure 91,000 registered patients/caregivers. time to start drumming up support outside of the community. your uncle that smokes, MAKE him go. your sister that doesn't smoke, but knows you do and sees it HELPS you, make her go.

we must band together, and start getting some ideas about WHAT to do.

Sept 7th needs to be a show of force. The only way we'll do that is by having a giant turnout. But I still believe standing out there for 3 hours will not accomplish anything. We need to be in their face as long as it takes for them to get the message. Like I said "Egypt Style".

It wont happen but wishful thinking none-the-less.

that would be ba good start. or maybe spend two ro three hours doing some leg work on this. call a bunch of attorneys. at the least we have a couple of small class actions that should have already been filed. the cards. the fact they are denying patients well after the 15 day mark.

how many of you guys live wthin a half hour drive of say genesee, or oakland county? maybe we should designate a meeting spot and start a committee. i'm willing to bet some of us have some good conections, that they would be willing to share in person.

I admire the drive and fortitude, but you can show up with million people... sad fact as that 995,000 will be the idiots that are making our laws diminish. The people took a foot when they got an inch in 2008, now they are going to have to face the sad truth. That there are too many greedy, criminal, morons bending, breaking and stretching the current laws getting in trouble, that why would they EVER give you more then you have now, best case scenario that we can still get our cards renewal time. That's about as realistic as you can expect with the way the idiots in MI have handeled this, I didn't expect any less.

ii agree tony-

so you're in with helping me change this?
how did we ever keep all these wannabes from fuckin up the party before?

and if you are one of these pindicks that thinks when he gets a bag of weed in his hand it magically turns to 500 a dollar an ounce shit, you need to realize he's right.
all your little bullshit fucked us. toldja. bet you didn't even save any of the money you made, huh? spent it all on kicks, stereo's and bj's?

and just like that it's all over.

for me too. i was counting on the compensation for my family, and already have plans to let a person like this locally in on a little "secret".

Nope, I don't like spending energy and money on losing battles. The odds are too great, and many are shooting themselves in the foot before you even start to support this cause.

You can't get rid of them, if you have the drive and energy then fight the battle, try to change them. You are fighting a losing battle though as they have something you cannot offer, monetary gain. Its a powerful drug more then the cannabis we love so much. So as you can see, I am a realist and know that it will never change while I am alive.
