What circumstances need to be in effect for me to confront someone standing in my neighbors patio late at night when i know my neighbors are asleep?

What circumstances need to apply for me to confront a salesperson at wal-mart where the furnace filters are?

If you cannot give me EXACT answers of ALL the circumstances that need apply, then you have come to a false conclusion.

you were the only one kind enough to prvide me with any evidence (albeit hearsay) about what those 8 eyewitnesses said. the best we got out of it was "staggering" with his arms up to some degree.
