Well, if America is the nation it says it is, then he will have a fair trial in front of a jury of his peers. Police can charge you with what ever they feel like, it's up to the judicial branch to provide it's checks and balances of the executive branch in the next step.

i mean, i feel like he is paying for the actions of the officer.

he should ask the prosecution to show the murder weapon.

well, i said i could see how they "logiced" it, not that it was very logical (oh tired and really stoned, perhaps couldave worded more carefully)

its a scaretactic.

and possibly done for the young policeman who murdered the boy.

it only makes sense in a very certainly disturbed mind.

I think the law is more of way to say don't committee felonys . Anything can happen during a crime and those doing the crime will be responsible for everything.
No crime was being committed at the time of the shooting. Unless walking is a crime.

They can't charge him with Conspiracy AFTER THE FACT. You see Conspiracy means that two or more people plan to Perpetrate a crime IN THE FUTURE. Nice try though.
Good call ND. Nice. Let me dig a little and see what i find. GREAT catch.

if you point a gun at a cop, it is a felony. so he was killed during the commission of a felony.

a 15 year old with a gun walking down the street is a crime.

i can see where both sides are coming from. UB made a good point when he asked if the cops were admitting to murdering someone. does the law say when a DEATH occurs during the commission of a felony, or a MURDER? im not sure, and it probably depends on the state. but if it says murder, then either the cop murdered him and they both go to trial, or she was acting in self defense and the kid should be let go.

what happens if you and some friends are doing coke at your house, but one friend decides to only drink(he is of legal age to drink). then the friend drinks too much and dies. do all the other friends go to jail? if the law says 'if DEATH occurs during the commission of a felony', then they could be tried. but how would that be fair? why is it the friends' fault that he HIMSELF decided to drink more than he should have? sure, maybe they couldve told em to slow down, but still....

so its these kinds of situations that make me think the laws may say MURDER, and not DEATH. actually maybe not the word murder, but another legal term for it

good distinction, actually.

lots of ins, lots of outs, lots of what have yous. a lot of strands to keep in the old duder's head.
I believe it stipulates that if a death occurs as a result of the crime(carrying a gun and pointing it at a cop or helping in the planning, commission, or aftermath such as pawning or fleeing) it becomes not justifiable homicide, but simply homoicide(murder).

Where in the story does it say he pointed the gun at her? It doesn't.. The kid being charged with the murder didn't even have a weapon.

But if hanging with someone who DOES point a gun at the police then one is held responsible for his choice in friends right?

Not even the kid that was with the one that got shot? Were the po-po expecting a weapon? Probably. Not justifying, just saying they may have had a few things on their mind. Gonna readit AGAIN. GOTTA see the truth, and thank you ND for encouraging me to investigate more.
