None the less the friend s an idiot but they should have never let the cop even pass the fucking door mat. Make them cock suckers go to the judge & get a fucking warrant. This case can go away easily my friend however your stories have to be together. Too many times have the police have ruptured cases just like this & the case gets thrown out. Spend a lil cash & get a private attorney. Trust me they'll make it go away.

Guts from a cigar is not enough for a warrant less search. Yes there were roaches upstairs however "Teddy" was not given permission to go upstairs after asking the defendant.

Your words against theirs. Judges now cops lie all the time. It will be up to your attorney to state the facts & embarrass the state attorney. Your attorney should also take depositions from the cops to catch them in their lies. All they do is propaganda their paperwork & reread that shit before a trial. Have faith, youll be alright. It is impossible to tell whether or not it was an illegal search without knowing what state you are in. I don't believe you have disclosed that to us yet and probably best not to. Your best bet (as stated in other posts above, I believe) is to do NOTHING ELSE. That is, don't remove the evidence, don't call the real estate agent, etc. No matter what state you are in, you should have been appointed a public defender. Call him or her and talk to them about what you have told us. If you can afford your own attorney, better yet. Most attorneys will talk to you one time for free anyway. Look in the phone book. You are lucky all you have been charged with is trespassing. If you talk to your lawyer, you may even be able to get that charged dropped. It certainly sounds like you may have a case for illegal search, but leave that to your lawyer. Anything you do now can only hurt your case. Good luck.

Get your own attorney, and make sure you get one who specializes in situations like this and has a real good track record. As has been said, you've pretty much done everything wrong up until this point, and the prosecution will be banking on you carrying that momentum into the court and making their case for them.

So get a top notch lawyer, put his # in your phone, and call that guy for permission before you so much as fart at a buddy's house. Guarantee you'll grow broke paying him, but it will be ALOT cheaper than the stat sanctioned financial raping that is only a few potential months down the road for you otherwise..

If you lose your head and let them secure the advantage, you'll get fucked, and bad. But if you keep your shit sparkling, and don't make any more wrong moves in this battle, you can pull out of this just fine. Sounds like they can't really hit you with worse than trespassing, unless they can keep playing you against your "buddy," and that's what, a fine and probation?

Pick your battles, if they're trying to take your freedom, go to war. But if they just want to get their jollies making you look silly, and collect a few hundred to a grand on the way, maybe you just need to move on and be glad you're not their latest 'Drug Kingpin' to be led to the slaughter.

Laws are not pertaining to this situation as none of the involved owned the property and all were criminally tresspassing. So probably what will happen if they all shut the fuck up is a criminal tresspass,proerty damge/vandalisim if they did anything to the proerty even if they think its an upgrade.Your prints and pictures will be in the system now.You might get a little more attention around town if your ina small town under 200000 people and you might get some fines and probation which could mean the dreaded piss test..call it a lesson in being stupid and havinga friend who you should kick the crap out of when this is all done and over with and then smash your own face into the wall for thinkig it was ok to go there when he was crawling in via the damn window

they did have reason to believe there was weed there they had evidence but regardless in my option they performed a illegal search you told them that you dident want them to go upstairs leagly they would have had to acquire a search warrent but by denieing them right to search you almost say yea i got weed up there so they would have no doubt gotten it approved but you would have most likely had time to get rid of the evidence, if a cop ever straight forward asks to search your property you should say yea sure after you show me a warrent its a iffy subject weather they have probable cause or not they do not have the athoutity to search your home without eather premission or a warrent seeing they dident have eather i say it was illegaly searched

the exception to the rule and may be the reason it went down the way it did is the dead owner wasn't present thusfor not giving you the right to deny entry or search

Lesson is never talk to cops. Do like the movies and say talk to my lawyer. They know a better story then u. Tell the lawyer everything. And if u get a public d. Make sure u ask for somone else if he does not work in ur best interest

Should be ashamed of your self or consider yourself lucky and pay your fines because I know people that have been shot over shit like this. Just my thoughts.
