DUI Thread

We all know how dangerous it is to drive drunk. But, you should know that a lot of what you hear is nothing but propaganda put out by the Government so that they can churn the system and make money.

To make matters worse, the zero tolerance laws in place make criminals out of law abiding citizens who have done nothing wrong. Not only is this a big cash grab, it is also a way of depriving the general public of their basic liberties under the guise of public safety.

The fact is most people drive just fine at .08% BAC - it is not until BAC approaches .15% that we see serious impairment. .08% is 2-3 beers for the average woman and 3-4 for the average man.

So basically, what the cops are doing is just randomly pulling over people who stopped off for happy hour, sticking their alcohol sniffing flashlights in the car and arresting people who are no danger to anyone and screwing their whole life up. And weed stays in your system for up to 30 days so if they decide to test you can be charged with DUI for smoking a joint a week prior to the stop.

See below for more info - this has got to stop.

I got an OWI for sitting in my car waiting for a ride. I had the keys in the ignition listening to the radio til my ride picked me up.

A car pulled in where i was parked and the headlights didnt look like my rides headlights so i figured it was another car. Turned out it was a cop. He smelled alcohol on me and gave me a breathalyzer.

Judge even said he was happy i wasn't driving.

That pissed me off more when he said that but i guess you can't have your keys in the ignition.

Well that's what happens when people organize and lobby for there own belivefs, Prime example M.A.D.D,,,The American way. Then each state, city, county, and local governments get in on all the profits to be made, by creating even worse way's to screw you for the money.

I know someone who has gotten 8 dui's over the last 30 years. The last one he got was 10 years ago, he still does it, but he doesn't get shit faced and do it anymore. 3-4 beers is all now.

Ever notice how many accidents that involve alcohol there are?

I'd be willing to compromise on DUI'S.....

No penalty up to .15, but anything over that the cops get to pistol whip you.

I got a dui, or i should say i was charged with a dui. I took the sobriety tests and passed all of the with flying colors... the dike bitch cop, pardon my french, still arrested me. I asked, " Why are you arresting me I know I passed all of those test, " She refused to answer me. I kept asking until her backup cop told me, "The tests are not on a pass or fail basis." What fucking bs. How is it based then, on a I'll give them the test just for the fuck of it and then arrest them no matter what. Needless to say, I was pissed at this point. Anyways, I continued to just be a complete asshole the entire time I was in the police station and told the bitch, word for word, " I gaurentee you I will get out of this." Anyways I'm a student so it cost me an assload of money for my lawyer, $2800 just for the d.a. to review the tape and see that she turned off the spotlight when she gave me the sobriety tests and all they could see were my feet. I walked the line perfectly and stood on one foot for double as long as I needed to my lawyer told me. So I just took a plea because the lawyer I had was trying to charger me another grand if it went to trial, which I couldn't afford. I had to pay a $600 improper lane use ticket!! Btw I refused to blow the 3 times I was asked, which is key if ever in my situation. Also, the cop followed me home from a bar, which they are not suppose to do! In closing, Fuck the Police!!!

The sobriety tests isn't a test, its a ploy to get you to incriminate yourself and give the cop evidence for court. Never agree to the tests.

A lawyer friend of mine told me of a case in which the cop's dash board recording was brought into court by the defense to show that the driver never swerved as the cop claimed. The Judge saw the evidence and simply didn't care.

Laws vary in different states but never admitting to drinking anything is the first line of defense. Also, there are other tricks you can learn about on line. If you get a fair judge these can help - if you get a Nazi maybe not.

Also know that cops have special flashlights that sniff alcohol so you want to roll down the windows prior to stopping crank the air and answer yes or no only.

And never under any circumstances be fooled into advocating your own loss of liberty like 90% of the idiots out there.

Funny you should mention that. One way the cops dupe the people is in the what they call "alcohol related."

If a person had 1 beer and is rear ended while sitting at a red light, not only is the accident called "alcohol related" but the guy who had the beer is automatically at fault.

ya, i know the majority of that info, everything except the flashlights. It was funny, on the way to the bar me and my buddies were talking about, "if you ever get a dui never blow." Lol

never EVER blow into the breathalizer, never EVER perform the field sobriety test, have them arrest you, take you to the drunk tank, keep quiet, dnt act inhebriated, and you could plea your charge down...

it sux that not blowing into the breathalizer is the same as automatically admitting that you are guilty in some places.... oh well

Exactly, they use alcohol as the bogie man and not the imbiber or the person responsible.

In my state, if you refuse to blow, you are automatically guilty.

^^^ not true it's not admitting you are guilty. The truth of the matter is that driving is a "privilege" or so they say and when you got your licence and sign those papers you are saying that the police can give you a breathalizer and you must blow or your licence will be suspended automatically for 1 years.

It is not related to your DUI charge, in fact the dui is completely separate. It is call "Statatory Summary of Suspension." Which even though I beat my dui I still had my licence suspended. If you do blow and fail the breathalizer you will have your licence suspended for 6 months. If you blow your pretty much fucked in court because you will never beat the charge with evidence against you. In my eyes I'd rather have my licence suspended, which i can get expunged, rather than get a dui and keep my licence for 6 months. Pluss if your convicted your court costs become like at least 5 grand and you have to take classes and now you have to get that machine that you have to blow into everytime you drive your car, which is expensive, also.

That is why you dont blow. I took the sobriety test because I was good drunk, you know the type of drunk when your better at everything:bigjoint:.

My buddy just got his 3rd a month ago. He may never get his license back.

The .08 is ridiculous... damn you M.A.D.D.

EDIT:

Just because a guy gets into a wreck after he's been drinking, doesn't mean it was because the alcohol. Sometimes it's actually an "accident".

You automatically have your license suspended if you refuse the test, and you can still get charged with DUI. They can give you jail time for refusing to blow too.

I got a DUI when I was 18. Lost my license for a year, $1500 fine, community service, 3 months of classes and I had to go to the LA county coroners to look at dead bodies for some reason. That was in LA county, I have friends that got DUI's in ventura county(next county over). They got their license suspended, a $3000 fine, community service, cal-trans, they had to get yelled at by a bunch of MADD mothers,9 months of classes, and a weekend in Jail. Luckily I got pulled over right before entering Ventura County.
