Tackled reporter now faces charges in Oaksterdam raid

Jose Alacran Gutierrez was among the throng of protesters and journalists that captured the federal raid on Richard Lee’s Oaksterdam University and Coffee Shop Blue Sky in Oakland, California. A veteran Bay Area beat reporter for Pacifica Radio, KPFA’s La Onda Bajita and the nationally syndicated Flashpoints shows and a longtime medical cannabis activist, Gutierrez was caught up in the raid as it unfolded outside Coffee Shop Blue Sky, brutally arrested by federal agents and charged with one federal felony count of forcible assault on a federal officer. He could face up to eight years in prison.

Over the last decade, hundreds of raids have been conducted where local law enforcement have been used for crowd control. The heavy-handed use of Drug Enforcement Agency (DEA), Internal Revenue Service (IRS) and US Marshals on April 2, 2012 was an unusual show of force by the federal government.

As part of their aggressive crowd control tactics, the Feds broke a window on the premises, scattering glass and pushing activists away from the main door. Live audio- and video-stream feeds reveal clearly the jostling of cameras, phones, and equipment as federal agents enter Coffee Shop Blue Sky. In a matter of seconds, Mr. Gutierrez is accosted and pinned to the ground by at least five federal agents. He is then seen being led to the patrol car that activists have blocked with their bodies. Spectators are heard and seen identifying which officers started the encounter. Others bang on the car windows after police shove Gutierrez in, with the crowd chanting and screaming, “Let him go! Let him go!”

This continued relentlessly as federal agents escorted the unmarked car down the street. Many witnesses recorded portions of the Gutierrez incident, leading his defense team to ask the public to post video or still footage on YouTube to show the whole truth and hopefully cause the charges to be dropped. From the recordings, it is obvious that Gutierrez suffered injuries which sent him to the hospital when the agents rushed him.

Out of the three arrests made that day, only Jose Gutierrez was taken into federal custody. Two others arrested by Oakland Police during the raid were released and the Alameda County District Attorney’s office filed no charges.

For over 20 years, Gutierrez has been a left-leaning political radio correspondent, giving a voice to the Chicano and cannabis communities. On sensitive, controversial issues like the legalization of medical cannabis, Pacifica Radio reporters and programmers are given a unique level of freedom to actively participate in the causes, organizations, and struggles of the communities they represent. These stories usually fall outside the corporate media model. By following stories from the Humboldt Hills to Oaksterdam on the beat of the legalization movement, Gutierrez has been a catalyst for the dissemination of vital information.

Gutierrez will be back in Federal Court July 10 at 9:30am, 1301 Clay Street, Oakland and needs court support. His case will be heard by Judge Donna Ryu.

I gave you the list of names, you do your own research for once.

As much as you love him, Obama could reschedule cannabis or shut down/change the mandate of the DEA with one stroke of a pen.

He may be the better of the two POTUS candidates, but he is extremely far from perfect and is leading his fan boys around by the collar. He's not even giving you a reach around after he fucks you.

His current policy is bend over and I'll fuck you, but I won't kill you. Hes a generous dude like that.

Why Uncle Buck seem to think "state complaint" growers busted would be documented as such and publicly available as that is beyond me. Beyond a simple google search showing many cases and claims, What we have is testimony from people saying they were state compliant and got busted. We also have cases such as prosecutors weighing the pots dirt and all and so forth, god knows how many dirty cops and prosecutors, its not uncommon. Why the fuck does Uncle Buck trust the police, lawyers, and government to do what is right? Does not compute in reality. Who is to say whats a plant? Whats a pound of marijuana? These things are not defined clearly in many state laws which contain many "grey areas" and loopholes were Innocent people fall victim, especially the poor and ignorant. Where is your compassion for the poor here?

If you think that everyone convicted of a marijuana crime (50% of arrests in 2008 I believe) were actually not state compliant in medical states or were guilt of a crime in non-medical states and should have their lives ruined then you are not only living in fantasy land but you are not compassionate, you are not the bleeding heart you claim, you are a fucking fraud and you are selling out humanity for something that is not justified for something that keeps the poor poor, that keeps the corporations monopoly strong, you sir are no friend of mine because you think I should be arrested if i were "non compliant" because you think that black impoverished men in the south should face decades and life sentences, because you actually believe that children should be taken away from their parents if they are caught with a dubbi, because you think that people should lose their homes and their jobs because of a natural herb, because you think that if a person in one of our 36 non-medical marijuana states should not be eligible for a job for the rest of their lives because of a single plant. You are no friend to humanity, you are a fucking sellout and poser.

This is even further evidenced by the fact that you yourself as a grower should understand that there is absolutely nothing wrong with marijuana and that it is not a crime. Again, You are nothing but a selfish poser and I have absolutely no respect for you because of this very thing.

You will now devolve into saying something like the president doesn't have control or the logistics of it or something just some fucking excuse to deny this. In advance I would like to say it doesn't fucking matter, you are claiming your supportive of this drug war or marijuana war and that it is somehow right, its just not right, there is no excuse to defend this, it is not right to defend marijuana laws as justified and that's that, that is the fact of the situation there is no excuse for it.


I fucking pray for the day that you get busted as "non-compliant", I would love to watch them weigh up your trimmings and call it marijuana and haul you off, and seize all your property putting you out on the streets. I am sure that the Millions of Americans arrested for Marijuana last year feel the same way about you. Not because I would like to see you "punished" its not that and not being mean spirited but I think you might learn your lesson in this situation, face up to the facts, and stop supporting this injustice.

Im a registered patient caregiver in a legal state. After getting sick a while back I could no longer tattoo full time, I had to find a different income. After a lot of reading and asking questions I decided to hire an attorney that specializes in MMJ. My income now is solely from being a caregiver. I understand I am still taking some risk and that sucks but I realize Im not really a target provided I follow regs and dont get greedy.

From everything Ive seen and read the Feds are going after large dispensaries and caregivers that get greedy. I dont agree with it, but it is what it is. I really cant see how any grower could at all support the war on MMJ or the war on drugs. Well, the only reason I can see is out of personal greed I suppose.

With that said, Im off to see my attorney and sign another freaking check :(

Sucks to have a system in place that I have to tip toe around and not be forthright about what it is that I actually do.

Since the federal crackdown began last year, the DEA has raided dozens of medical-cannabis dispensaries from Michigan to Montana. Haag, the U.S. attorney for Northern California, claims the federal action is necessary because the state's legalized pot dispensaries have been "hijacked by profiteers" who are nothing more than criminals.

It's true that California has no shortage of illegal pot dealers. Nonmedical marijuana is the state's largest cash crop, raking in an estimated $14 billion a year. And demand is growing, in part because former governor Arnold Schwarzenegger thwarted a ballot measure aimed at full legalization in 2010 by removing criminal penalties for possession of up to an ounce of pot. But instead of focusing limited federal resources on off-the-grid growers in places like Humboldt County, who are often armed and violent, Haag targeted Matthew Cohen, a medical-marijuana farmer in Mendocino who was growing 99 plants under the direct supervision of the county sheriff. As part of a pioneering collaboration with local law enforcement, Cohen marked each of his plants with county-supplied tags, had his secured facility inspected and distributed the mari*juana he grew directly to patients in his nonprofit collective.

Cohen appeared to be precisely the kind of caregiver that the Ogden memo advised should be given safe harbor for operating in "clear and unambiguous compliance with existing state law." But last October, DEA agents stormed Cohen's farm in the middle of the night and cut down his crop. Sheriff Tom Allman, who learned of the raid on his turf only an hour before it was executed, was outraged. "Matt Cohen was not in violation of any state or local ordinances when federal agents arrived at his location," Allman says. In January, Haag took the fight to the next level, threatening county officials like Allman with federal sanctions. Three weeks later, county supervisors voted to abandon the program to license and monitor Mendocino's legal growers. "This is a huge step backward," says Allman.
